The New York State Department of Environmental Conservation (NYS DEC) is pursuing a Department Initiated Modification and renewal to the State Pollutant Discharge Elimination System Permit NY0072061 pursuant to 6NYCRR Part 750-1.18, New York State DEC's Environmental Benefit Permit Strategy. A combined notice of intent to modify, notice of legislative public comment hearing, and notice of public comment period was published in the Environmental Notice Bulletin on January 6, 2010, with the public comment period ending on March 22, 2010. CWM has requested an extension of the public comment period. As a result, the public comment period will be extended until April 30, 2010.

Written comments must be submitted to the contact listed below by close of business April 30, 2010.

Amendment of sections 190.10 and 190.25

Pursuant to Environmental Conservation Law, Sections 1-0101(3)(b), 3-0301(1)(b), 3-0301(2)(m), 9-0105(1), 9-0105(3), 45-0111(6) and 45-0117(2)(n), the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:

Amendment of sections 190.10 and 190.25 for the protection of the Zoar Valley Multiple Use Area including the Zoar Valley Unique Area.

Negative Declaration

Allegany County - The Village of Richburg, as lead agency, has determined that the proposed Village of Richburg Public Water Supply Improvements will not have a significant adverse environmental impact. The action involves a proposal for improvements to the public water supply system consisting of installation of water booster pump stations, replacement of water main, water tank renovations, three water main creek crossings, and replacement of all shutoff service valves within the system. The project is located at 210 Main Street in the Village of Richburg, New York.
