Public Notice

The New York State Department of Environmental Conservation (NYS DEC) has received a Brownfield Cleanup Program (BCP) application from Crème de la Crème (Mount Kisco), Inc. for a site known as the Undeveloped Parcel, Site ID #C360112. This site is located in the Town of Mount Kisco, within the County of Westchester, and is located at 6 Morgan Drive, Mount Kisco, NY 10549.

Comments regarding this application must be submitted no later than March 26, 2010.

Negative Declaration

Sullivan County - The Town of Bethel Town Board, as lead agency, has determined that the proposed Adoption of Local Law #1 of 2010 will not have a significant adverse environmental impact. The action involves the adoption of Local Law #1 of 2010 to amend the Town of Bethel Code Chapter 345, Section 24(A) to expand the opportunities for Conservation Subdivision to three additional zoning districts in the Town; G-17B, RD, and R-17B. The project is located throughout the Town of Bethel, New York.

Positive Declaration and Public Scoping

Ulster County - The Town of Lloyd Town Board, as lead agency, has determined that the proposed Mountainside Woods may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. Written comments on the draft scope will be accepted for seven (7) days following the close of scoping session. A public scoping session will be held on March 10, 2010 at 7:30 p.m. at the Town of Lloyd Town Hall Meeting Room, 12 Church Street, Highland, NY 12528. The draft scope has been posted to the Town website: www.townoflloyd.com and is available at Town Hall. The action involves a residential development consisting of 158 single family homes and 17 two family homes (17 single family homes with accessory apartments) on 175 lots. The project will require Town of Lloyd Town PRD designation and Town of Lloyd Planning Board Subdivision and Site Plan Approval. The project will affect only approximately 34 acres of a 154 acre site. The project is located at Vista Drive and Toc Road in the Town of Lloyd, New York.

Notice of Acceptance of Final EIS

Ulster County - The Town of Lloyd Town Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Highland Square. The Final EIS is posted on the Town's website at: www.townoflloyd.com and copies are available at the Town of Lloyd Town Hall at the address listed below. The action involves a petition to the Town Board by DES Development LLC to change the zoning on the property from Design Business to a Planned Unit Development District (PUDD). Upon rezoning, the applicant will subdivide the property into three separate lots, containing 10.19 acres (Lot A), 11.02 acres (Lot B), and 0.98 acres (Lot C), respectively.

Lot A will be developed as an assisted living community, as well as medical facilities, medical offices and associated parking. The buildings on Lot A will contain approximately 183,000 square feet of floor area, with building coverage of 64,600 square feet. Lot B will be developed as a shopping center with a mix of retail space, restaurants and office space in approximately 105,850 square feet of building space. Lot C will contain a one story bank building with approximately 6,630 square feet of building floor area with associated parking. All three lots will share a signalized access point off of Route 299. The project is located at the northwest corner of the intersection of Route 299 and Route 9W in the Town of Lloyd, New York.

Westchester County - The Town of Cortlandt Planning Board, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Mill Court Crossing. Copies of the Final EIS are available for review during regular working hours from 9:00 a.m. to 4:00 p.m., Monday through Friday, except holidays, in the Planning Division Office of the Department of Technical Services, Cortlandt Town Hall, 1 Heady Street, Cortlandt Manor, New York. A copy of the Final EIS is also available for review at the John C. Hart Memorial Library, 1130 Main Street, Shrub Oak, NY 10588, the Putnam Valley Library, 30 Oscawana Lake Road, Putnam Valley, NY 10579. The online version of the Final EIS is available at the following publically accessible web site: www.townofcortlandt.com.

The action involves an application (PB 13-05) submitted by Kirquel Development Ltd. for Preliminary Plat Approval pursuant to Sections 276 and 277 of the New York State Town Law and pursuant to Chapter 265 (Subdivision of Land) of the Town of Cortlandt Code. This application is also for Permits pursuant to Chapter 179 (Freshwater Wetlands), Chapter 259 (Steep Slopes) and Chapter 283 (Trees) of the Town of Cortlandt Code. The subject application (and the DEIS as submitted) is for a proposed 22 lot major subdivision and other related site improvements on 52.78 acres of property as shown on a 15 page set of drawings entitled "Subdivision and Site Development for Residences at Mill Court Crossing" prepared by Cronin Engineering, P.E., P.C. latest revision dated July 8, 2009 and on drawings entitled "Preliminary Landscape Plan" and "Stone Wall Plan" both prepared by Tim Miller Associates, Inc. and dated July 21, 2009. The project is located on the west side of Lexington Avenue, across from Strawberry Road, and at the south end of Mill Court in the Town of Cortlandt, New York.
