Project Description:

The applicant has requested renewal of the expired sand and gravel Mining Permit noted above (extended under the State Administrative Procedures Act), which includes a wet processing plant, and modification of the existing Mined Land Reclamation plan for that property. The present reclamation objective after completion of currently limited mining operations (about 12 ± acres) is to return the property to an agricultural/meadow land use. The requested modification of that plan, in the future, would be to use 29 acres of the 154 acre Life of Mine Limits on the property for a lumberyard/log storage area.

The applicant proposes to mine sand and gravel and material processing with a pipe screener, on 3.93 acres out of a 14.25 acre parcel of land. Mining will occur below the groundwater table, resulting in a 1.8 acre lake. The estimated life of the mine is 2 to 3 years, and the reclamation objective is for a private, family recreational area with a lake. The project site is on the east side of Barbertown Road, on the north side of East Carroll Road, and west of Oswayo Creek, in the Town of Portville, Cattaraugus County.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue the renewal of the Title V Permit for the General Motors (GM) Tonawanda Powertrain Engine Plant located on River Road in the Town of Tonawanda. GM operates an engine manufacturing plant with various permitted, exempt and trivial emissions. The draft permit allows continuation of the existing plant operations with some changes to address the reduction of operations at the plant, data corrections and streamlined permit conditions. Significant changes to the permit conditions include the elimination of 40 CFR Part 64, Compliance Assurance Monitoring (CAM), for the plants two 585 hp natural gas fired mechanical pump drive engines since the CAM criteria is no longer met. The frequency for emission testing the engines has been decreased from annual to once every 5 years. Other minor changes clarified report submission requirements and exempt sources of degreasers.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. The Draft Permit and Permit Review Report may be viewed and printed from the DEC web site at: http://www.dec.ny.gov/chemical/32249.html.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below.
