Project Description:

The Department has received a request for a new permit to operate air pollution sources and has drafted pursuant to Article 19 (Air Pollution Control) of the Environmental Conservation Law, a State Facility Permit, for the facility to be located at, ELG Utica Alloys Inc, Town of Herkimer in Herkimer County, New York. The exact location will be at 378 Gros Boulevard. This facility is engaged in the recycling of titanium and nickel-based metals. These metals are sorted, sized, washed/degreased and dried. The Standard Industrial Classification representative of this facility is 5093 (Scrap & Waste Materials). With respect to air pollution regulation, the activities of concern at ELG are various. Various metal Hazardous Air Pollutants (HAPs), hydrogen chloride and particulate matter will be emitted from a drying process. The facility will also emit volatile organic compounds (VOC) from several degreasing operations. Several baghouses, cyclones and thermal oxidizers have been installed to reduce these air pollutants.
The facility has elected to cap VOC and HAP emissions below Major Source Thresholds.

The draft permit with all conditions is available for review in the Region 6 NYSDEC sub-office in Utica, NY.
The Department has made a tentative determination to issue the permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. The approved application is for a new permit for a proposed discharge of 0.04 MGD consisting of 0.036 MGD of treated process wastewater and 0.004 MGD of treated sanitary wastewater into Beaver Brook, a class C(T) waterbody from an advanced activated sludge and an industrial wastewater treatment system at the applicants facility located at 378 Gross Boulevard, Town of Herkimer, Herkimer County. The applicant plans to operate a new facility engaged in the recycling of titanium and nickel-based metals.

This tentative determination indicates that a discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, the tentative determination does not signify department approval for or endorsement of the activity for which the permit is sought or for the overall proposed project. This Department has received a request to issue a permit modification and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at Barrett Paving Materials, 363 Rasbach Rd., Litchfield, NY, 13322. The Department has made a tentative determination to approve the application of the Barrett Paving Materials facility, a crushed stone and asphalt production facility. The purpose of this modification includes the replacement of 6" X 16" triple deck screener, 3 conveyors with 4 conveyors, adding a new 6" X 16" double deck screen and replacing a 400 ton per hour horizontal impact crusher with a 375 ton per hour HazenMag K1515 horizontal impact crusher. The Air State Facility Permit allows the operation of Emission units 1-PLANT, 2-STONE, and 3-GENST which includes asphalt production including waste oil as a fuel, crushing and screening of stone including temporary portable operations, diesel generator operation, and exempt and trivial sources. The facility has capped out of Title V, and NOx RACT. Permitting requirements by tracking and restricting its facility emissions of Particulate Matter less than 10 microns in diameter (PM-10), Oxides of Nitrogen (NOx), and Carbon Monoxide (CO) below 95 tons per year. The draft permit with conditions is available for review in the Region 6 NYS DEC office in Watertown, New York.

This Department has received a request to modify a permit and has drafted an Article 19 (Air Pollution Control) of the Environmental Conservation Law, an Air State Facility Permit, at the facility located at St Elizabeth Hospital; 2209 Genesee Street; Utica, NY 13501.
The Department has made a tentative determination to approve the application of the St Elizabeth Hospital's Air State Facility Permit. The modification to the State Facility Permit allows the operations of emission units UCHP01, which includes the operation of three internal combustion engines connected to electric generators to produce electricity for St Elizabeth Hospital. The operation also includes three heat recovery units that utilize the heat from the engine exhaust to produce steam for heating and other requirements at the facility. The State Facility Permit also allows the operation of emission units UBOILR and USTERL, which includes the operation of three existing boilers using natural gas or number 2 fuel oil to supplement the the combustion engine system to meet requirements for the facility, and the operation of an ethylene oxide sterilizer for surgical equipment. This modification also includes the removal of three older existing boilers that were decommissioned in 1999, to make room for the engines. The facility has capped out of Title V Permitting requirements by tracking and restricting it's emissions of Sulfur Dioxide, Nitrogen Oxides, and Carbon Monoxide not exceed 100 tons per year. The facility is also subject to 40 CFR 60 Subpart Dc and JJJJ, and 40 CFR 63 Subpart WWWWW.

Project Description:

The DEC has received a request to issue a permit and has drafted an Air State Facility permit pursuant to Article 19 of the Environmental Conservation Law. The facility is a State University of New York college located on Pierrepont Avenue in Potsdam, New York. The original facility consisted of two dual fueled (natural gas and No. 2 fuel oil) boilers that supplied steam for the campus facilities. The facility intends to add two internal combustion engines to produce electric power and steam for the Potsdam campus. Facility emissions being capped are Oxides of Nitrogen, Carbon Monoxide, and Sulfur Dioxide under 6 NYCRR Part 201-7.2. Without these caps in place, the facility would be major for these pollutants and therefore subject to Title V of the Federal Clean Air Act. The draft permit with conditions is available for review in the Region 6 NYS DEC office in Watertown, New York.
