Project Description:

The mining of sand and gravel from approximately 115.5 acres of land, consisting of 41 acres owned by Karr Valley Road Associates and presently permitted by the department for mining, and 74.5 acres owned by Hubert and Virginia Wightman, of which 7 acres are permitted by the department for mining, and 67.5 are proposed to be mined. Karr Valley Road Associates' permit will be modified to include the Wightman's existing permit and the land proposed for expansion. The modified permit will include revisions to the mining and reclamation plan for the existing areas to correlate with the mining and reclamation plan for the 67.5 acre expansion area. Material processing will include a screener, crusher, and wet processing in a closed loop wash plant system and settling ponds. The reclamation plan is for agricultural land with stable side slopes. The project site is located north of Interstate 86, south of Karr Valley Road, and west of Woodlawn Lane.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0000973), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).

The West Valley Demonstration Project, located in the Town of Ashford, Cattaraugus County, discharge consists of process wastewater, water production wastewater, north plateau surface water/groundwater recovery and treatment, NDA groundwater interceptor, and miscellaneous contaminated groundwater and stormwater, sanitary wastewater, utility wastewater. Treatment consists of low level (liquid) waste treatment facility skid A, skid B and lagoons. There is also a mercury pretreatment process at the source. The effluent from mercury treatment is designated at outfall 01B. Sanitary wastewater treatment consists of extended aeration activated sludge. The facility has surface discharge into Erdman Brook Segment (D) of Frank Creek (C), class D water.

The following changes to the permit are proposed:

Outfall 001: Limits and sampling frequency on various parameters have been changed. New parameters have been added.
Outfall 01B: Interim permit limit for mercury has been revised.
Outfall 007: Monitoring frequency on various parameters have been changed. New parameters have been added.
Stormwater outfalls: S02, S40 - Outfalls removed. S43 - Included from live Fire Range. S20 - Mercury is included.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
