Public Notice

Award of Contract pursuant to Section 120-W of the General Municipal Law

On the 25th day of January, 2010, the Counties of Warren and Washington Industrial Development Agency awarded a contract to American Steel Processing Co. pursuant to section 120-w of the General Municipal Law for purchase and hauling of recovered metals. The validity of the Recovered Metals Purchase and Haul Agreement or the procedures which led to its award may be hereafter contested only by action, suit or proceeding commenced within sixty (60) days after the date of the notice, as described in Section 3, herein, and only upon the ground or grounds that: (a) such award or procedure was not authorized pursuant to Section 120-w of the General Municipal Law; or (b) any of the provisions of Section 120-w of the General Municipal Law which should be complied with at the date of the publication of the notice have not been substantially complied with; or (c) a conflict of interest can be shown in the manner in which the contract was awarded; or by action, suit or proceeding commenced on the grounds that such contract was awarded in violation of the provisions of the Constitution.

Notice is hereby given that the Office of Mental Retardation and Developmental Disabilities has determined that the former Hostel 11849 on NYS Route # 30, Town of Wells, Hamilton County, consisting of 1.586 ± acres of vacant land, is no longer useful or necessary for their purposes and has declared the same abandoned to the Office of General Services for sale or other disposition as Unappropriated State land.

Project Title: New York RSA No. 2 Cellular Partnership, d/b/a Verizon Wireless

Location: County Route 26, Town of Duane, New York.

Project Description: The project involves the lease of a 55 foot x 70 foot area on a 0.50 acre parcel owned by the Duane Volunteer Fire Company, Inc. to Verizon Wireless for the construction of an 80 foot tall triangular self-supporting latticework tower. Verizon proposes to locate a 12 panel array at the top of the tower and a 12 foot x 30 foot equipment building at the base of the tower. An ice bridge will protect the wires that connect the tower to the equipment building and the entire complex will be surrounded by a chain link fence. The existing access to the firehouse from County Route 26 will also provide access to the tower location. Utilities will be installed underground. Two omni antennas and a lightning rod are also to be attached to the top of the tower. The lightning rod will extend 10 feet above the top of the tower for an overall height of 90 feet. One 8 foot omni antenna is proposed by Franklin County Emergency and another 6 foot omni antenna is proposed by the Duane Volunteer Fire Department. Both omni antennas will extend above the top of the tower.
