Project Description:

The applicant proposes the reissuance of a previously held Solid Waste Management Facility permit that expired on May 31,2005. The applicant specializes in the collection, transport and transfer of RCRA hazardous materials from industrial, commercial, educational and governmental customers.

Waste materials are transported to the Ashland facility in Binghamton via company owned tractor-trailers operated by company employees. All materials arrive at the facility in DOT approved containers, including 5 gallon pails, 55 gallon drums, cubic yard boxes and totes. Hazardous materials are handled, sampled and segregated under a separate permit, DEC# 7-0302-00068/00011 and EPA # NYD049253719.

The non-hazardous materials are segregated from the hazardous waste materials and stored in two separate storage bays. These materials are fully labeled with a non-hazardous waste label and profiled on a company Profile sheet. These non-hazardous materials are stored in the bays until enough materials are available (hazardous and non-hazardous, typically eighty-eight to ninety-two 55 gallon drums) to fill a trailer. These materials are then transported offsite to an approved disposal facility, where they are disposed in accordance with applicable regulations.

The non-hazardous waste storage bays are capable of storing 780 fifty-five gallon drums of material. The storage bay areas are curbed to help contain any possible spill or leak and there are no floor drains in the bay areas. The bay storage areas are not exposed to the outside environment, thus eliminating the potential for materials to be impacted by storm water runoff. No putrescible materials are handled by this facility. Rodents, vermin or odors are not a factor in the operation.

Typical operational hours of the facility are from 7:00 a.m. to 5:00 p.m., Monday thru Friday. Drummed materials may be held on site for a maximum of 180 days. The applicant however, estimates that the average turn around time is less than 21 days.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal Title V Air Facility Permit and a Title IV Acid Rain Permit for the operation of the Oswego Harbor Power facility located at 261 Washington Blvd., Oswego, NY.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V and IV files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC that are relevant to this permitting decision should contact the DEC representative listed below. Filed application documents, and Department draft permits, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. The applicant proposes to install approximately 38,000 feet of new water main to serve 51,800 gallons per day of potable water from OCWA to the new district along portions of Bardeen, Hogs Back and Cowen Roads, US Route 11, Switts Drive and others in the Town of Hastings.
