Project Description:
The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0026522), pursuant to 6 NYCRR Part 750-1.18, and 750-1.19, the Priority Ranking System known as New York State's Environmental Benefit Permit Strategy (EBPS).
The Port Jervis Sewage Treatment Plant located in the City of Port Jervis, Orange County, has a design flow of 2.5 mgd. Treatment consists of grit removal, primary settling, trickling filters, clarification, and chlorination. Sludge is hauled to a landfill. The facility has treated surface discharge of treated wastewater to the Neversink River, a class B water.
The following changes to the permit are proposed:
Delaware River Basin Commission requirements to monitor Nitrate, Nitrite and Total Phosphorus once per quarter have been added.
The action level for copper was replaced with a water quality based effluent limit of 1.2 lbs/day.
The Mini-Pretreatment Program was modified to extend the due date for submission of a revised sewer use ordinance and give credit for work completed.

State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Feb 19, 2010.

Project Description:
The project sponsor proposes to construct a single family residence to be connected to municipal water and sewer at 61 Old Sleepy Hollow Road. The lot will also include a driveway, site drainage and limited grading. The construction of the driveway will result in 845 square feet of permanent impacts to the 100 foot Adjacent Area of NYSDEC Wetland A-9.
