Project Description:

The Department has made a tentative determination to approve this application for modification to an existing SPDES permit # NY-0250678 for Splash Down Beach, located at 16 Old route 9 West, Fishkill, to discharge an additional 3000 gallons per day (GPD) of sanitary wastewater from Outfall 003 to groundwater and an additional 500 GPD of pool filter backwash from Outfall 004 to groundwater. The discharge of 2500 GPD of sanitary wastewater to groundwater from Outfall 001 and the discharge of 662 GPD of pool filter backwash from Outfall 002 remain unchanged. The existing overflow structure at Outfall 002. which potentially discharged to NYS freshwater wetland WF-11 (Class 1) has been removed and will be sealed to prevent future surface discharge from or infiltration to the outfall tank.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz. The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits.

The Town of Clarkstown proposes to conduct work within a 1,300 linear feet stretch of the East Branch Hackensack River [Index# NJ-1-12-13, Class A] that encompasses all of Heaton's Pond and areas just upstream and downstream from Heaton's Pond. The proposed project activities include:

(1) removal of ~ 4,900 Cubic Yards of sediment from Heaton's Pond;
(2) stabilization of of stream banks; and
(3) installation of energy dissipaters in the channel immediately down stream of the spillway.

The Town of Clarkstown has received funding from the New York State Emergency Management Agency's Disaster Recovery Program to preform these activities.
