Project Description:

The applicant proposes to construct a 10 foot wide driveway crossing of a finger of NYS Freshwater Wetland DP-22 (Class 1) and its 100 foot adjacent area, associated with the construction of a single family home. The driveway will traverse 30 feet of wetland proper and 100 feet of wetland adjacent area resulting in a total wetland disturbance of 1,441 square feet and total disturbance of 4,695 square feet within the 100 foot adjacent area. A 36" culvert pipe will be installed to maintain hydrologic connectivity on either side of the wetland crossing.

Project Description:

The DEC has tentatively determined to issue a modified State Pollutant Discharge Elimination System (SPDES) permit to the above-referenced applicant. This modification is based upon an April 2, 2008 permit modification request and subsequent information submitted on August 25, 2009, October 7, 2009 and October 27, 2009. This modification request is meant to reactivate the existing sand filter units that were removed from service when the upgraded wastewater treatment system was installed in 2000. The facility is requesting use of the existing sand filters for additional polishing of the treatment plant effluent. The facility performed a pilot test to document the treatment system performance from June 2008 to May 2009. As the wastewater treatment system is already meeting current SPDES permit limits, the use of the sand filters has been identified as optional. Based upon review of the information provided, the SPDES permit has been modified to allow the use of the sand filters units.

The Permit has been modified as follows:

-The permittee name on page 1 of the draft permit has been updated from Hudson Valley Fois Gras, LLC to HVFG, LLC to address the 2005 change of ownership.
-The outdated permit limits, levels and monitoring page for the treatment system that was present before the 2000-2001 plant expansion to 20,000 gallons per day has been removed.
-The settleable solids limit has been reduced from 0.3 ml/l to 0.1 ml/l to reflect technology based discharge limits for a filtered effluent.
-The seasonal disinfection period has been extended from May 15 - October 15 to May 1 - October 31 to eliminate confusion over reporting disinfection parameters for only half of the months of May and October.
-A treatment system process diagram showing the monitoring locations has been included on page 8 of the draft permit.

Project Description:

The applicant proposes to remove an 8 foot high by 10 foot wide stone and masonry dam from a Class C tributary to the Wallkill River. The water level of the ponded area behind the dam will be lowered prior to dam removal via an existing two foot diameter steel culvert pipe located at the base of the dam. Hydraulic analyses indicate that the stream and existing drainage structures can adequately accommodate post construction stormwater flows.
