Project Description:

The New York State Department of Environmental Conservation (NYSDEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002 2756, DEC Identification #:7-0542-00004/00001), the Village of Moravia pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). The most significant proposed changes to the permit are as follows: The ammonia limit for the months of November through May are established at 7.4 mg/l as a 30 day average. Previously, this parameter was "monitor" only by the permittee without an existing limit. This new limit is based on ammonia toxicity standards that were revised in the early 1990's and after the initial permit limits were established for this facility. All other limits are protective of water quality and have not been changed. All permit changes and existing permit requirements are drafted to be protective of water quality in the Owasco Inlet.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to operate a new 69.5 acre sand and gravel mine on a 147.5 acre parcel owned by Jeffrey Hopkinson located southeast of the intersection of Lovers Lane and Base Bridge Road. No mining will occur within state protected wetlands or 100 foot protected adjacent areas. No processing will occur on site. Reclamation shall be a 50+/- acre pond and grass plantings. The mining application and plans are available for review in the Syracuse Office.

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
