The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) §27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor (named above) has submitted a BCP application asking that this site be admitted into the BCP.
NYS DEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository location at the address indicated below.
Please note that the application package includes a Remedial Work Plan (RWP). The work plan has been adopted from another document, called a Proposed Remedial Action Plan (PRAP), which was developed for the site by the NYS DEC. The Site had been known as Edgewood Warehouse (Site No. E907032). It was being addressed by the City of Dunkirk through New York's Environmental Restoration Program. At this time the Requestor intends to acquire the Site with the understanding that it will implement the PRAP. The PRAP/RWP is available for review and comment with the Application.
NYS DEC will review the application package and public comments received and then make a determination on the eligibility of the application and on the PRAP/RWP.
The comment period will run from December 23, 2009 until February 5, 2010.

Erie County - The State University of New York (SUNY) College at Buffalo, as lead agency, has determined that the proposed New Student Housing will not have a significant adverse environmental impact. The action involves the demolition of the existing asphalt parking lot "l" on the SUNY College at Buffalo Campus for the construction of a 3 wing, 222,000 ± square foot student apartment complex with associated site improvements. The student apartment complex will house 504 beds in 135 suites and include laundry and support services. Site improvements will consist of loading plaza, access driveway, green space, landscaping, and utility infrastructure. The project is located east of Grant Street, west of Rees Street, and north of Letchworth Street on the SUNY Buffalo Campus, (former site of parking lot l) in the City of Buffalo, New York.
