Project Description:

The Department has made a tentative determination to issue a new SPDES permit to East Resources Inc. to discharge approximately 42,000 gallons per day of municipal drinking water, from a source approved by the SRBC, into groundwater for use in performing injectivity tests at the Gutchess No. 1 Well, located approximately 4000 feet west of Hardscrabble Road, north of Draht Hill Road, in the town of Elmira. As a tentative determination, the Department is seeking comments prior to making a final decision. The permit and application file are available for review and comment at the NYSDEC Region 8 Avon Office.

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
