Project Description:
The Department has made a tentative determination to approve this application for a modification of the State Pollutant Discharge Elimination System (SPDES) permit issued on October 1, 2008 to discharge brine to the groundwater. The modification is to change an additional requirement on the existing permit from "Wastewater disposed at this facility shall be limited to gas production brines from the list of Columbia owned and operated wells provided by Mr. James Mottesheard in a June 4, 2004 letter to Joanne March, NYSDEC, Region 7." to "Waste Material: Wastewater disposed of at this facility shall be limited to gas production brines as limited and listed in the Facility's USEPA Underground Injection Control (UIC) permit, Class IID, Permit Number NYU119501, as modified October 2009. The permittee is authorized to inject only brines produced from gas production wells owned and /or operated by the permittee and producing from the Trenton Black River and/or Queenston Formations.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:

Project Description:
The applicant proposes to replace the existing Haiti Road Bridge on an adjacent alignment over the Seneca River. Heavy stone will be placed in front of the new abutments to protect the disturbed slopes along the Seneca River. The new structure will accommodate a single 12 foot travel lane with 2 foot shoulders for a rail-to-rail width of 16 feet. The existing structure will be removed after traffic has been shifted to the new structure.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
