Project Description:

The Department of Environmental Conservation (DEC) has determined to renew the above referenced State Pollutant Discharge Elimination System (SPDES) permit on a standard five-year term. The Town of Marlborough, the facility owner, allowed the permit to expire in 2007 and DEC required submittal of a new application. After full technical review, an updated permit has been drafted and the application for renewal of this permit called complete. The permit authorizes discharge in the amount of 5,500 gallons per day of treated sanitary waste from the Milton Wastewater Treatment Plant into an unnamed tributary of the Hudson River.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0021571), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).
The Town of Ulster Whittier Sewer District STP is a wastewater treatment facility that has a design flow of 0.100mgd. Treatment consists of screening, primary settling, rotating biological contactors, final settling, and chlorination. Sludge is pumped to a sludge drying bed. The facility has surface discharge into the Hudson River, a Class A water.

The following changes to the permit are proposed:

- Permit pages and conditions have been updated to reflect current DEC guidance, format and nomenclature.
- A Total Residual Chlorine limit has been included to prevent the excessive use of chlorine and to protect the water quality of the receiving water.
- A simplified Mercury Minimization Program has been added.
- A Best Management Practice procedure for reducing mercury has been added.

Project Description:

The applicant proposes to dredge approximately 18,000 cubic yards of accumulated sediment from the Hudson River within the perimeter of the Tarrytown Marina, in order to re-establish pre-existing berthing depths. A turbidity curtain will be employed to contain turbid water within the facility perimeter and the dredged sediments will be dewatered and disposed of at an upland location.
