Project Description:

The Department has made a tentative determination to approve this application for a new permit for a proposed discharge of up to 0.72 million gallons per day of treated groundwater into the Hudson River (Class I) via NYCDEP Outfall NR-043 from a treatment system consisting of a settling tank, bag filters and liquid phase carbon adsorbers at the applicant's project site located in the Manhattanville area in an area roughly bounded by Broadway, W 129th St, 125th St, St Clair Pl and the Henry Hudson Parkway in Manhattan where the applicant will construct new combined and storm sewers.

State Environmental Quality Review (SEQR) Determination:

A final enviromental impact statement has been prepared on this project and is on file.

SEQR Lead Agency: NYC Planning Commission

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

NOTE: New York City Economic Development Corporation, 110 William Street, 3rd Floor, New York, NY 10038, is co-applicant on this application with 10 South Street Associates LLC.

The applicant proposes to repair and renovate the interior of the 100-year-old Battery Maritime Building, to demolish an existing one-story structure (added in the 1950s) atop the original three-story Building, and construct a four-story addition (three full stories and a setback penthouse story, plus mechanical housing on the roof) on top of the original Battery Maritime Buildiing for a 138-room hotel and a 750-seat restaurant. The renovation of the original Building, which includes the passenger waiting area known as the Great Room, would be designed to accommodate a mixture of new public and private uses. The first floor of the Battery Maritime Building currently accommodates active ferry service to Governors Island, tour boat uses, and a ground floor waiting area for ferry and tour boat passengers, with some vacant areas. The upper floors are currently vacant. The Battery Maritime Building rests on a pile-supported platform located over the waters of New York Harbor in lower Manhattan, just east of the Staten Island Ferry Terminal. As part of the proposal, new housing structures for utilities and elevator mechanisms will project below the platform deck above the water. The Battery Maritime Building is listed on the State and Federal Registers of Historic Places, and is a New York City landmark.

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYC Dept of Small Business Services test

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
