New York State Department of Environmental Conservation Amendment of section 196.4 of 6 NYCRR
Pursuant to Environmental Conservation Law, Sections 1-0101(3)(b),1-0101(3)(d), 3-0301(1)(b), 3-0301(1)(d), 3-0301(2)(m), 3-0301(2)(v), 9-0105(1), and Executive Law section 816(3) the New York State Department of Environmental Conservation (NYS DEC) hereby gives notice of the following:
Amendment of Section 196.4, 6 NYCRR which authorizes an interim permit system that sets limits on the time and frequency of flights to Lows Lake.
Purpose: To authorize an interim permit system that sets limits on the time and frequency of flights to Lows Lake until December 31, 2011.

Project Title: New York RSA 2 Cellular Partnership d/b/a Verizon Wireless

Project Description: The project is a subdivision into sites involving the lease of a 100 foot x 100 foot parcel to Verizon Wireless for the construction of a 129 foot telecommunications tower designed as a simulated tree. A twelve panel array will be attached to the tower with the top of the panels located at 119 feet on the tower. The project also involves the placement of a 12 foot x 30 foot equipment building within a fenced compound at the base of the tower and an ice bridge between the tower and the equipment building to protect the cables that connect the antennas on the tower to the equipment building. The new tower will be located 355 feet from Main Street (NYS Route 73) and 159 feet from the West Branch of the Ausable River.

Project Title: T-Mobile Northeast, LLC - Lewis Site
Location: County Route 10 in the Town of Lewis, New York.

Project Description: The project involves the construction of a new 90 foot tall telecommunications tower (i.e., monopole) with three flush mounted panel antennas centered at 87 feet on the tower on a 50 foot x 50 foot leased parcel. The overall height of the proposed tower with a 5 foot lightning rod will be 95 feet. The applicant also proposes three equipment cabinets on a concrete pad at the base of the tower and a backup power generator all covered by a 10 foot x 16 foot canopy. Also proposed is an ice bridge to protect the cables connecting the tower to the equipment cabinets and a chain link fence around the 28 foot x 32 foot equipment compound. Access to the tower location will be over an existing paved and gravel and road. There will be space on the tower and within the equipment compound for co-location by another telecommunications carrier. The site is also the location of another previously authorized 79 foot tall telecommunications tower. Utilities to the site are installed underground.

Project Description: The operation of a Class A Marina offering vessel and marine storage, product sales, service and repairs, fuel sales, towing and winter boat storage for up to 202 vessels.
Negative Declaration
Saratoga County - The Town of Saratoga Planning Board, as lead agency, has determined that the proposed Independent Towers LLC Communications Facility - Saratoga Landfill will not have a significant adverse environmental impact. The action involves the construction of a new wireless telecommunication facility by Independent Towers, LLC. Independent Towers proposes the construction of a new one hundred and ninety (190) foot tall monopole tower contained within a 60 foot x 80 foot (4,800 square foot) fenced compound on a 100 foot x 100 foot (10,000 square foot) leased area with all necessary appurtenances, cabling, and fixtures. Associated unmanned equipment will be located within the fenced compound. The facility will be capable of supporting the co-location of additional wireless carriers. The facility will
be accessed via the existing landfill access driveway with an approximate 45 foot x 12 foot extension comprised of non-impervious gravel with improved drainage per local regulations. The project is located on Hayes Road at the Town of Saratoga Landfill in the Town of Saratoga, New York.

Saratoga County - The Town of Saratoga Planning Board, as lead agency, has determined that the proposed Cellco Partnership d/b/a Verizon Wireless - Burgoyne Wireless Telecommunications Site will not have a significant adverse environmental impact. The action involves the the construction of a proposed Cellco Partnership 100 foot Monopole (105 feet when including a lightning rod), 11 foot 6 inch x 30 foot 0 inch equipment building on a concrete pad within a 44 foot x 54 foot fenced compound and associated improvements for the proposed wireless telecommunications facility. Access from Walsh Road will be provided over a 280 foot of existing gravel driveway and 570 feet of proposed 12 foot gravel driveway. The project is located at 180 Walsh Road in the Town of Saratoga, New York.
