Project Description:

The applicant proposes to drain an existing pond and decommission (remove) an existing dam structure which impounds two tributaries to the Kinderhook Creek. The project is located on Garfield Road in the Town of Stephentown, Rensselaer County.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The NYS DOT proposes to replace the existing Ferry Road bridge structure with a new bridge located parallel and approximately 20 feet east of the current structure within the back channel of the Mohawk River and NYS Freshwater Wetland N-102. The project also includes placement of fill for the future incorporation of an access walkway from Rosendale Road to the existing bike path and replacement/installation of a water main. The project will result in approximately 0.50 acres of wetland impacts and 2.24 acres of temporary impacts associated with a construction access road and relocation of the existing water line. As mitigation, the NYS DOT will establish 0.28 acres of emergent wetland, 0.04 acres of open water, enhancement of 0.09 acres of uplands and install an elliptical culvert to connect two wetland areas to improve wildlife passage and hydrology, all on the project site.

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: NYS Dept of Transportation

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
