Project Description:

The Town of Arcadia proposes to create the Arcadia Water District #11 to take for use therein a supply of water up to 23,350 gallons per day from the Wayne County Water and Sewer Authority's Village of Newark Canandaigua Lake source. The project includes the installation of 37450 linear feet of 8-inch water main and appurtenances to serve 170 dwellings. The project includes crossing the regulated 100-foot adjacent area of Freshwater Wetland NE-34, NE-47 and north of NE-40. Crossing of a stream designated as C(T) standard for trout spawning, located south of Miller Road, is also required. The file is available for review and comment at the NYSDEC Region 8 office.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is a Type I action and will not have a significant effect on the environment. A coordinated review with other agencies was performed and a Negative Declaration is on file.

SEQR Lead Agency: Arcadia Town Board

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Nov 27, 2009.

Project Description:

The applicant proposes to subdivide an approximately 16-acre property into four (4) residential lots, place one (1) new dock as a means of providing water access, and cut cattails. The proposed dock and vegetation clearing is being done in the 100-foot adjacent area of State Freshwater Wetland NW-8. Project includes a dock that is 3 feet wide by 70 feet long and establishment of a right-of-way for an existing dock that will be shared. Cutting of a section of cattails in 100-foot adjacent area that is 10 feet wide by 15 feet deep is proposed where the dock meets the shore to allow for small boat access, as well as maintenance of a common access path to the existing dock that will now be shared. The project requires an Article 24 Freshwater Wetlands permit as the total project will require approximately 0.5 acres of disturbance to Freshwater Wetland NW-8.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
