Greene County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Transfer of Mount Hayden will not have a significant adverse environmental impact. The action involves the transfer of an 804 acre parcel of land referred to as the Hayden Parcel currently owned by the New York City Department of Environmental Protection (NYC DEP) to the New York State Department of Environmental Conservation (NYS DEC). The NYS DEC currently manages the property under a permit from the NYC DEP. Transferring the parcel to the NYS DEC will afford it additional protection under Article 14, Section 3 of the New York State Constitution, which states lands situated in a forest preserve county lying outside of the park boundary may be managed for forest conservation purposes. These lands may not be sold or transferred without Constitutional amendment. NYS DEC will manage these lands as Reforestation Areas pursuant to Section 9-0105 of the Environmental Conservation Law. The project is located in the Town of Windham, New York.
