Project Description:
The proposed action is the mining of clay, on approximately 6 acres of land within 33 acres owned by the applicant at the project location. The clay material is to be sold and trucked off-site. Mining, as planned, will create a pond 2.7 acres in size. The pond excavation will be 14 feet deep and will be reclaimed, with side slopes 3:1 (horizontal on vertical). The pond will have an approximate water depth of 12 feet. The stated reclamation objective is a recreational pond and the estimated life of the mining operation is 2 years.

State Environmental Quality Review (SEQR) Determination:

State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
The applicant proposes expansion of an existing landscaping business by construction of a 3,960 square foot equipment storage building, a 2,080 square foot warehouse building, and other necessary appurtenant structures within the regulated 100-foot-wide adjacent area of State wetland HB-2. The project requires a Department SPDES general permit for stormwater discharges due to construction activities. Cleanup and enhancement to the remaining regulated wetland adjacent area within the property boundary will be required as mitigation.
