Project Description:
COMBINED NOTICE OF PUBLIC COMMENT PERIOD, PROPOSED PERMIT MODIFICATION, and AVAILABILITY TO REVIEW DRAFT PERMIT
The following describes a proposed modification of the Hazardous Waste Management Facility Permit (Part 373 Permit) for Eastman Kodak Company's (Kodak) Kodak Park Division facility, which is located within the Eastman Business Park, portions of which are within both the City of Rochester and the Town of Greece in Monroe County. The modification involves the addition of a new HW Management Unit, HWMU 33. HWMU-33 is located at Building 322 and consists of two existing tanks with a total capacity of 65,000 gallons. Kodak is requesting authorization to store off-site generated hazardous waste solvent in the two existing storage tanks prior to solvent reclamation in Kodak's Building 322 Distilling operations. The existing tanks are currently used to store similar materials generated by Kodak at the Kodak Park Division facility.The permit will also be modified to update the facility's Emergency Coordinator.
The Department is interested in receiving comments from the public and other governmental agencies regarding their review of the documents and the proposed modification. The public comment period begins with the publication of this Notice. All comments will be considered in making the final decision regarding this action. A response to any comments submitted will be issued which will identify any changes to the proposed action and will describe and respond to the issues raised. A notice of the decision will be sent to each person who submits written comments or who requests such notice. A public hearing will be scheduled if warranted based on the comments received. Comments must have been submitted in writing or via e-mail (palent@gw.dec.state.ny.us) by December 7, 2009 to the contact person at the Department's Region 8 Avon Office, who is listed at the end of this Notice.
The modified draft Part 373 Permit is available for review at Kodak's Neighborhood Information Center- Building 28, located at 200 West Ridge Road in the City of Rochester, and at the Department's Albany and Avon offices. Lent at (585) 226-5390 and at the address listed below. Other related documents are available for review at the Department's Albany and Avon offices and it is recommended that an appointment be scheduled by phone to review the files in the DEC's Central and Region 8 Offices. The Department will endeavor to make the files available within 2 business days of contact, during normal business hours (8:30 AM through 4:45 PM), unless the requester wishes to inspect the files at a later date.
Availability of Application Documents:
Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.
State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Dec 07, 2009.
