Project Description:

The applicant proposes to renew an existing SPDES permit, and increase the discharge to 130,000 gallons per day of treated backwash wastewater to Climax Creek, a Class C waterbody, from the applicant's water treatment facility located on Titus Mill Road, Climax, NY, as part of a facility upgrade and to meet existing demand. The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project. A draft permit is available for inspection and comment at the Region 4 office. SPDES # NY0268267.

A Structural-Archaeological Assessment Form has been completed. The proposed activity will not impact on registered, eligible or inventoried archaeological sites or historic structures.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to construct a driveway on the 27.5 acre parcel to access an upland site for the construction of a single family residential home. The driveway construction will permanently fill approximately 0.22 acres of the 0.98 +/- acres of federal wetland identified on the site. To mitigate for wetland impacts, approximately 0.26 acres of wetland will be created adjacent to existing wetlands and the remaining wetland areas will be preserved in perpetuity by placing a declaration of restrictive covenants on these lands. The parcel is located along the north side of Whitmyer Drive adjacent to the waste water treatment plant.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
