Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) and renewal to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0031828), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

The Carmel SD#6 - Ivy Hills wastewater treatment facility is located in the Town of Carmel, Putnam County. The facility has a design flow of 50,000 gpd. Treatment consists of activated sludge system that includes a comminutor, bar screen, aeration basins, clarifiers, chlorine contact tank and intermittent sand filters. The facility has surface discharge to an unnamed tributary of Osceola Lake, a Class C water.

The following changes to the permit are proposed: pH range has been changed based on technology based standards. Effluent disinfection has been changed from all year to seasonal based on water quality standards. Water quality based effluent limits of 7.0 mg/l from June to October and 14.0 mg/l from November to May for Ammonia Nitrogen has been added. Bi-monthly monitoring for Total Phosphorus has been added. The total residual chlorine limit was changed based on a regulatory standard for protection of aquatic life. The existing limit will remain in effect as an interim limit until upgrades are completed in accordance with the schedule of compliance. A Short Term High-Intensity monitoring schedule has been added. Sampling for parameters will be required. Discharge Notification Requirement section has been added. A monitoring locations section has been added. Permit pages and conditions have been updated to reflect current DEC guidance, format and nomenclature.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to construct a 135 linear foot rip-rap lined swale to convey stormwater from a detention basin through a portion of the 100 foot adjacent area of Freshwater Wetland PE-2 (Class II) for discharge. The project is a component of construction of a 72,000 square foot warehouse with paved parking on a 9.36-acre site. No disturbance to the wetland is proposed; the total area of disturbance to the adjacent area of the wetland is less than 0.06-acre. The project is located on the north side of Fields Lane, west of Sutton Place, in the Town of Southeast, Westchester County.

Project Description:

The applicant proposes to fill a total of 0.26 acre of federally-regulated wetlands in seven different locations associated with the construction of a new commercial development. The 71-acre parcel is proposed to be subdivided into five parcels with immediate construction of a new 89-room hotel and eventual development of two additional commercial sites, a 150,000 square foot retail site, and a 48-unit residential development. All but one of the wetland disturbances is associated with the construction of the main access road to be dedicated to the Town upon completion. The largest area of wetland fill (0.09 acre) is proposed in association with the construction of the hotel.

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
