Project Description:


The New York State Department of Environmental Conservation (DEC) has prepared a draft permit and has made a tentative determination to issue a new State Facility Permit for the operation of Watervliet Arsenal located on Broadway, Watervliet, NY 12189, owned by the Department of the U.S. Army. Watervliet Arsenal (WVA) is the U.S. Army?s manufacturing facility for large caliber cannons and associated parts, and is the home of Benet Laboratories. The types of operations and emission sources at WVA include natural gas and No. 2 fuel oil fired boilers, spray coating operations, fiberglass composite operations and various metal finishing processes. The application was submitted to change from current registration status to an Air State Facility permit.

In order to continue to remain below the applicability threshold for Title V permitting, the applicant has proposed restricting the potential to emit through enforceable permit conditions which will limit or cap emissions at a level which is less than 100 tons per year for sulfur dioxide and oxides of nitrogen. The applicant has agreed to permit conditions which will limit sulfur dioxide emissions by restricting the sulfur content of the fuel oil and fuel oil usage of the boilers. The facility will be required to maintain records and report this data to verify compliance with permit conditions and limits.

Persons wishing to inspect the subject Air State Facility files, including the application, with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below.

DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the DEC representative listed below. If comments are received which raise significant issues or provide additional relevant information, the DEC may modify the draft Air State Facility Permit.

Project Description:

The applicant proposes a new 1,956 gallons per day surface discharge of wastewater from floor drains through an oil/water separator associated with the construction of two bus storage bays in addition to the existing bus garage. The outfall will discharge to an area adjacent to the West Branch of the Delaware River from the applicant's facility located at State Route 10 north of the hamlet of South Kortright. The department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify department approval for or endorsement of the activity for which a permit is south or for the overall proposed project. No further review in accordance with SHPA is required.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a modification Title V Air Facility Permit for the operation of the Hess Rensselaer Terminal facility located at 367 American Oil Road, City of Rensselaer, County of Rensselaer, owned by the Hess Corporation. The department has initiated this modification to include the throughput capping requirements for the facility to cap hazardous air pollutants below the applicability thresholds of 40 CFR 63, Subpart R.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.
