Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0004600), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

Wyeth Pharmaceuticals has a SPDES Permit for the discharge of non-contact cooling water, HVAC and stream condensate, and stormwater. The facility has surface discharge to Muddy Brook (via Reed Pond) and Cherry Creek, both Class C waters. The facility also has a small onsite subsurface disposal system for sanitary wastewater.

The following changes to the permit are proposed:

- Coverage of stormwater discharges in accordance with federal regulations have been added, as well as permit conditions and requirements for the development and implementation of an Industry Best Management Practices (BMP) Plan. A schedule of compliance has been added to address the development of the Industry BMP Plan. Upon issuance of this permit modification, the facility may terminate coverage under the SPDES Multi-Sector General Permit for Stormwater Discharges associated with Industrial Activity (Permit ID NYR00C564).
- A footnote has been added to Outfall 01A for total residual chlorine discharge limit to clarify that testing will be conducted using HACH DPA Method 8167. The monitoring frequency was increased from twice a month to weekly.
- Permit pages and conditions have been updated to reflect current permit language, DEC guidance, format and nomenclature.

The applicant proposes development of 118 residential units on a 38.4 acre parcel which contains NYS Designated Wetland WO-13 (Class II). The Sandburg Creek (#H-139-14-38-3) Class B(t) runs through the northern portion of the parcel and will be crossed during the development. The proposed project will contain 34 duplex buildings, 14 townhouses, and two three-story midrise buildings with each midrise containing 18 units.The applicant proposes to connect to existing municipal water and sewer service.

Project Description:

The applicant is proposing a temporary crossing of State Regulated Freshwater Wetland HA-40 (Class II) which is also a tributary of the Bush Kill (NYS water Index # D-1-22-3, Class B) a protected waterbody. The crossing will be approximately 75 feet wide be located at the narrowest portion of the wetland to reduce impact and will be in place for a duration of no more than 2 months. The purpose of the wetland/stream crossing is to facilitate access to the southern portion of the site to install test wells and evaluate capacity for an associated proposed 2,557 unit development referred to as Lost Lake Resort. This proposed project is subject to an Environmental Impact Statement. The information obtained from this well pump testing will be included in the Draft EIS. No test wells are proposed to be located in the wetland or regulated 100 foot adjacent area. All material will be removed upon completion of test wells and associated pump tests.

The Department has made a tentative determination to approve this application for a SPDES permit to allow a new surface discharge (Outfall No. 001) of a maximum of 5,000 gallons per day (gpd) of wash and rinse water to the Dwaar Kill (Class C) from curing and smoking processes, and consolidate an existing groundwater discharge (Outfall No. 002) of 228 gpd of sanitary wastewater from restrooms at the Catsmo Smokehouse. The project involves the construction of a new wastewater treatment plant (WWTP) with outfall to the Dwaar Kill at the fish smokehouse located at 25 Myers Road, southeast of the intersection of Bruyn Turnpike and Hoagerburg Road in the Town of Shawangunk, Ulster County. A draft permit is available for inspection and comment at the regional office.

Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY0021563), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

The Town of Ulster Sewer Improvement Area (SIA) #1 is a sewer treatment plant located in the City of Kingston, Ulster County. The facility has a design flow of 1.6mgd. Treatment at the facility consists of primary clarification, submerged biological contractors, secondary clarification, and UV disinfection. Three of the four outfalls at the facility are stormwater catch basins which discharge to the municipal storm sewer. The facility has surface discharge to the Esopus Creek, a Class B water.

The following changes to the permit are proposed:

- Water quality based effluent limit (WQBL) for copper has been reduced based on regulatory standards for protection of aquatic life.
- The action level for nickel has been reduced to reflect the performance level of the facility.
- A quantification and removal study has been added and an interim effluent limit for bis(2-ethylhexyl)phthalate until the DEC's review of the study to determine whether the WQBL can be achieved or a modified effluent limit should be considered.
- The monitoring requirement and action levels for chromium and gold were deleted. A review indicates the inclusion of these parameters is no longer necessary.
- Three stormwater outfalls have been added. These outfalls discharge stormwater collected on the facility into the municipal storm sewer which discharges to the Esopus Creek. Development and implementation of a stormwater pollution prevention plan (SWPPP) has been added. An action level for chemical oxygen demand and monitoring requirement for total suspended solids has been added to verify the effectiveness of the SWPPP.
- Whole Effleunt Toxicity action levels and footnote have been added.
- A mercury minimization plan has been added. - A monitoring location page has been added.
- Addresses, permit pages and conditions have been updated to reflect current DEC guidance, format and nomenclature.
