The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) §27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor (named above) has submitted a BCP application asking that this site be admitted into the BCP.

NYS DEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository location at the address indicated below.

NYS DEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Notice of Public Comment Period

Proposed Well Spacing Variance

Project Description and Location: Alden Aurora Gas Co., Inc. (Alden Aurora or Applicant) has applied for a well permit and variance to the well spacing requirements set forth in Title 6 of the Official Compilation of Codes, Rules and Regulations of the State of New York (6 NYCRR) Section 553.1(a) to drill the Zoladz 3 (API 31-037-26369-00-00) Medina natural gas well on acreage to be designated as the Zoladz 3 Spacing Unit in the Town of Darien, Genesee County, New York. The Applicant proposes to drill, complete and produce the well, but needs a variance from the well spacing provisions set forth under 6 NYCRR 553.1(a) which require that, in the absence of a Department order establishing spacing units, a well cannot be closer than 1,320 feet from any oil and gas well in the same pool. A permit to drill is also required by 6 NYCRR 552.1.

The New York State Department of Environmental Conservation (NYS DEC) has proposed an order regarding the granting of a well spacing variance. NYS DEC supports the granting of the requested variance and issuance of the drilling permit.

Public Comment Period: All persons, organizations, corporations or government agencies which may be affected by the draft order are invited to submit written comments. The public comment period will remain open until November 13, 2009. Written comments on the draft order should be submitted to: John K. If no substantive and significant issues are identified regarding the draft order at the end of the comment period, the order will become final and binding on the Applicant and its successors and assigns. Pursuant to the final order, the Department will grant the variance and issue a permit to drill the Zoladz 3 well at the proposed location subject to site-specific conditions as warranted.

Issuance of the permit to drill will provide for recovery of the natural gas resource in accordance with the policy provisions of ECL §23-0301.

Negative Declaration

Chemung County - The Village of Horseheads, as lead agency, has determined that the proposed Site Plan Approval for an Oilfield Service Facility (Schlumberger) will not have a significant adverse environmental impact. The action involves the development of approximately 88.53 acres of vacant property into a 65 ± acre natural gas servicing facility. The new facility will contain approximately 400,000 square feet of building space and employ up to 400 new employees, of which 75% will be locally hired personnel. The project is located at the Center of the Village of Horseheads Industrial Park in the Village of Horseheads, New York.

Steuben County - The City of Corning Planning and Zoning Commission, as lead agency, has determined that the proposed 17-19 Denison Parkway will not have a significant adverse environmental impact. The action involves the demolition of two commercial buildings and construction of a 19 space parking lot. The project is consistent with the City's Master Plan and Denison Parkway Design Guidelines. The project is located at 17-19 Denison Parkway in the City of Corning, New York.
