COMBINED NOTICE OF PUBLIC COMMENT PERIOD, PROPOSED PERMIT MODIFICATION AND REMEDY TO ADDRESS SITE CONTAMINATION
The following describes a proposed modification of Module II (Corrective Action Requirements for Solid Waste Units) of the Hazardous Waste Management Facility Permit (Part 373 Permit) for Eastman Kodak Company's (Kodak) Kodak Park Division facility, which is located within the Eastman Business Park, portions of which are within both the City of Rochester and the Town of Greece in Monroe County. There are two specific changes related to this particular permit modification. The first change, pursuant to Condition C. 5 of Module II, is the selection and implementation of the final corrective measures for addressing soil and groundwater contamination for Investigation Area SIA - 502/605, located in the west-central portion of the KPS section of the Eastman Business Park, which is in the Town of Greece and is bordered by Lee Road on the west, Mt. Read Blvd. on the east, Lexington Ave. on the south and Ridgeway Ave. on the north. Two functionally equivalent remedies have been identified as suitable for investigation area SIA-502/605. Alternative 1 would involve removal and off-site disposal of contaminated soils from the former Veterans Auto salvage yard area. Alternative 2 involves placing protective cover over those soils to reduce potential exposures. Both alternatives include institutional controls (property deed and access restrictions) on future use of the impacted area and the annual certification that remedial elements are in place and continue to be effective. Either alternative would be considered an acceptable final remedy for this investigation area. The Department has prepared a Statement of Basis document supporting the tentative selection of final corrective measures for Investigation Area SIA-502/605. The second change is to add Building 514, also located in the KPS section, as an Investigation Area into the table entitled Corrective Action Compliance Schedule for RFI (RCRA Facility Investigation) Work Plans, which is found in Condition D.1.(b) of Module II of the permit. A Draft revised Module II has been prepared which incorporates any revisions required by this modification.

The Department is interested in receiving comments from the public and other governmental agencies regarding their review of the documents and the proposed modification. The public comment period begins with the publication of this Notice. All comments will be considered in making the final decision regarding this action. A response to any comments submitted will be issued which will identify any changes to the proposed action and will describe and respond to the issues raised. A notice of the decision will be sent to each person who submits written comments or who requests such notice. A public hearing will be scheduled if warranted based on the comments received. The comment period will end on November 9, 2009, the date by which all comments must have been submitted in writing to the contact person at the Department's Region 8 Avon Office, who is listed at the end of this Notice.

The Statement of Basis and the draft revised Module II of the Part 373 Permit are available for review on the Department's website at http://www.dec.ny.gov/permits/6061.html. Copies of the documents are also available to be reviewed at Kodak's Neighborhood Information Center, Building 28, located at 200 West Ridge Road in the City of Rochester, and at the Department's Albany and Avon offices. Project Description:

The applicant proposes to replace a culvert under County Route 86 at a tributary to Mine Creek (Class C stream). This culvert work is being done in the 100-foot adjacent area of State Freshwater Wetland BO-2. Project involves building a temporary detour through a wetland (approximately 275 feet), replacing the 2 existing pipe culverts (60 feet) with a new concrete box culvert (80 feet), realigning a stream to achieve a better approach angle to the road and culvert, and relocating an electric line requiring the placement of a new utility pole and movement of an existing pole. The detour will be removed and wetlands restored upon completion of project. The project requires an Article 24 Freshwater Wetlands permit as project will require approximately .05 acres of disturbance to Freshwater Wetland BO-2.

Project Description:

In an effort to improve Clyde River water quality and facilitate the use of non-motorized water craft, Wayne County, in conjunction with the New York State Department of Transportation, are proposing to remove accumulated sediments from a 1600 feet section of the Clyde River, from the intersection of Schwab/Lyons- Marengo Rd. east to Pond Brook. They are also proposing to replace the existing 48 inch culvert under Lyons-Marengo Rd. with a 21 feet wide by 14 feet tall arch culvert. The new navigable channel will be limited to a width ranging from 30 to 40 feet within the existing 130 wide stream channel. A portion of the 8,000 cubic yards of accumulated sediment that will be removed contains elevated concentrations of heavy metals and semi-volatile organic compounds (SVOCs). The sediment that is removed from the river will be placed in an existing NYS Canals Upland Disposal site located on Creagar Island.
