Project Description:

The Department of Environmental Conservation has initiated a reissuance and modification of the State Pollutant Discharge Elimination System (SPDES) permit for the Noxon Knolls STP. This proposed issuance is undertaken pursuant to 6NYCRR Part 750 and Part 621. The permit will be placed on a standard five year term with the following changes: Permit Pages: Updated permit pages are used based on current Department guidance, format and nomenclature. Permit pages are renumbered and reordered. The address for Albany and the Regional Water Engineer on the Recording, Reporting, and Monitoring page have been updated. A compliance schedule for the installation of the facilities to achieve dechlorination to a concentration of 0.1 mg/l, is included in the permit.

Outfall Information: Discharge is through outfall 001, to the unnamed tributary of Wappingers Creek. The receiving water at the point of discharge has been assigned a classification of "B", pursuant to Title 3 of Article 17 of the Environmental Conservation Law, and 6NYCRR Part 858.
Outfall 001 is located at Lat 41° 39' 10", and Long 73° 51' 45".

Permit Limits and Conditions: The permit is for a discharge of 33,000 gallons per day (gpd), and was first issued with an effective date of December 1, 1988, and has been subsequently extended and renewed. The permit expired on December 1, 2008, and is now being reissued with a 5 year term after the permittee submitted a new application to DEC. No changes in effluent limitations are proposed.

State Environmental Quality Review (SEQR) Determination:

Project is not subject to SEQR because it is a Type II action.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to construct 72 townhouse units with internal access roads, parking areas and recreational facilities on approximately 40 acres of an 85 acre parcel on the western side of South Road within the Village of Wurtsboro at the former J.A. Morrison Farm Complex. The project will utilize the existing Village water supply system. A community wastewater treatment system with subsurface disposal of treated effluent is proposed to be built in an area located outside the jurisdiction of DEC Freshwater Westland YL-37 (Class 1) and its associated 100 foot adjacent area. This new system will have a design capacity of 17,282 gallons per day and will be authorized under the Department's Private/ Commercial/ Institutional State Pollutant Discharge Elimination System (P/C/I SPDES) permit.

State Environmental Quality Review (SEQR) Determination:

SEQR Lead Agency: Wurtsboro Village Board

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The applicant proposes to construct improvements to an existing access road, replace utility lines, and construct a new pump house within the 100 foot adjacent area of Freshwater Wetland GA-24 (Class III), in conjunction with the construction of a new potable water treatment plant (WTP) at the Wallkill Correctional Facility. The project is being constructed to meet requirements of the NYS Department of Health and will provide filtered water to the facility and the Shawangunk Correctional Facility via a new connection to the NYC Catskill Aqueduct. The total area of disturbance to the wetland is less than 0.1 acre; the total area of disturbance to the adjacent area of the wetland is approximately 1.45-acre. The project is located at the Wallkill Correctional Facility, on the east side of NYS Route 208 in the Town of Shawangunk, Ulster County.
