Brownfield Cleanup Program

The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) §27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor (named above) has submitted a BCP application asking that this site be admitted into the BCP.

NYS DEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository located at the address indicated below.

Please note that the application package includes the Remedial Investigation & Interim Remedial Measures Work Plan which describes the remedial activities to be conducted to investigate and determine the nature and extent of the contamination related to the site.

NYS DEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Erie County - The New York State University Construction Fund (NYS UFC), as lead agency, has determined that the proposed State University College at Buffalo Demolition of Laundry/Bakery (SUCF Project 03390) and Construction of New Technology Building (SUCF Project 03383) will not have a significant adverse environmental impact. The action involves the demolition of the bakery and laundry buildings along the north side of Rockwell Road, including all asphalt, in the first phase and construction of a 78,460 gross square foot Technology Building on the site of the demolished buildings in the second phase. The south side of the site will be re-established as open space. Entry plazas to the building will extend from north and south to meet pedestrian sidewalks. Existing parking along the western side of the site will provide access to the new building for faculty and students. The project is located at the State University College at Buffalo, 1300 Elmwood Avenue in the City of Buffalo, New York.

Erie County - The New York State Department of Environmental Conservation (NYS DEC), as lead agency, has determined that the proposed Chaffee Landfill Facility Borrow Area will not have a significant adverse environmental impact. The action involves the excavation of 2 new on-site borrow areas totalling 29.4 acres to be developed for the excavation of clay. The borrow areas have a projected life of about nine years after which reclamation to wetland, pond and meadow is proposed. No off-site transport of materials is proposed. The project is located at 10860 Olean Road in the Town of Sardinia, New York.

Wyoming County - The Town of Pike Town Board, as lead agency, has determined that the proposed 2009 Amendments to the Town of Pike Comprehensive Plan will not have a significant adverse environmental impact. The action involves the proposed amendments to the Town of Pike's Comprehensive Plan due to the dissolution of the Village of Pike effective the 31st day of December, 2009. The project is located throughout the Town of Pike, New York.
