Shandaken SPDES Semi-Annual Meeting

TheNew York City Department of Environmental Protection (NYC DEP) hereby gives notice that a meeting will be held from 10:00 a.m. to 12:00 p.m., on Wednesday, September 30, 2009, at the Sugar Maples Center for Creative Arts, 34 Big Hollow Road, Windham, NY. The meeting is being held in accordance with State Pollutant Discharge Elimination System (SPDES) Discharge Permit No. NY 026 8151, for the Shandaken Tunnel Outlet. NYCDEP will discuss the progress of several projects in the Catskill watershed region as well as conduct a site walk at a Stream Management site near the Sugar Maples Center. Appropriate foot wear is recommended.

The meeting is open to the public.

Negative Declaration

Sullivan County - The Sullivan County Legislature, as lead agency, has determined that the proposed Sullivan County Property Acquisition and Jail Construction will not have a significant adverse environmental impact. The action involves the construction of the new Sullivan County Jail with an approximate size of 248,000 gross square feet at full build-out. The County proposes to acquire a total of approximately 40 acres, of which approximately 20 acres will be developed with the jail facility. The current jail, located in the Village of Monticello, will be abandoned. At full build-out the jail will house approximately 500 inmates and employ 154 staff. The project also includes the extension of public water and sanitary sewer service to the site from connections near Raceway Road across Route 17. Propane tanks will be located on-site to provide energy for heating and cooking, and parking, lighting and pedestrian walkways will be provided. The project is located along County Road 174 in the Town of Thompson, New York, approximately one mile west of the Village of Monticello, near Interchange 104 of NYS Route 17.

Ulster County - The Town of Rochester, as lead agency, has determined that the proposed Town of Rochester Zoning Update will not have a significant adverse environmental impact. The action involves a comprehensive update of the Town of Rochester Zoning Law (Chapter 140 of the Town of Rochester Code). The purposes of the update is to insure that the zoning code is consistent with the Town of Rochester Comprehensive Plan adopted in November, 2006. In considering the adoption of these updated zoning laws, the Town of Rochester Town Board utilized, considered and incorporated the 2006 Comprehensive Plan and all appendices to such plan including: a summary of results of the Comprehensive Plan Outreach; a draft natural resource inventory; the New York Rural Water Association Report; an analysis of demographics of the Town of Rochester; and a cost community services study, among others. The Comprehensive Plan Report and appendices are included and incorporated into the full environmental assesment and environmental review prepared for the herein action. The project is located thorughout the Town of Rochester, New York.

Conditioned Negative Declaration

Rockland County - The Town of Clarkstown Planning Board, as lead agency, has determined that the proposed United Structural Works will not have a significant adverse environmental impact provided specific conditions are met. There will be a 30 day public comment period commencing with the date of this notice. The action involves the construction of a 40,550 square foot office/warehouse/fabrication facility on 6.1 acres of LIO (Light Industrial Office) zoned land. The project is located on Hemlock Drive, Congers, New York, 1000 feet east of Route 303 on the west side of Route 9W.

The conditions are:

Specific mitigation measures imposed as part of Conditional Negative Declaration:

No parking signs covering the entire length of the south side of Hemlock Drive shall be installed. An enforcement agreement between the owner of Hemlock Drive and the Town of Clarkstown shall be established to allow for the enforcement of said no parking.

Notice of Acceptance of Draft Generic EIS and Public Hearing

Dutchess County - The Pleasant Valley Town Board, as lead agency, has accepted a Draft Generic Environmental Impact Statement on the proposed Pleasant Valley Comprehensive Plan, Zoning Code, Zoning Map and Subdivision Regulations. A public hearing on the Draft GEIS will be held on September 30, 2009 at 7:00 p.m. at the Pleasant Valley Town Hall, 1554 Main Street, Pleasant Valley, NY. Written comments on the Draft GEIS will be accepted until October 12, 2009. A hard copy of the Draft GEIS is available at the following locations: Pleasant Valley Town Hall Clerk's Office, 1554 Main Street, Pleasant Valley, NY and Pleasant Valley Library, 1584 Main Street, Pleasant Valley, NY and the following publically accessible web site: http://pleasantvalley-ny.gov/. The action involves the adoption of a proposed Comprehensive Plan and amendments to the Zoning Law, Zoning Map and Subdivision Law, which have been proposed to the Town Board by the Town of Pleasant Valley Comprehensive Plan and Zoning Committee in consultation with the Dutchess County Department of Planning and Development.

The draft Comprehensive Plan outlines policies and recommendations to guide the Town's future decision making, policies, capital improvements, and community investment. The proposed amendments to the Zoning Law/Map and Subdivision Law reflect, and are based upon the Comprehensive Plan's vision, policies and recommendations. The project is located throughout the Town of Pleasant Valley, New York.

Notice of Acceptance of Final EIS and Public Hearing

Rockland County - The Town of Clarkstown, as lead agency, has accepted a Final Environmental Impact Statement on the proposed Hyenga Lake. A public hearing on the Final EIS will be held on October 7, 2009 at 7:30 p.m. at the Clarkstown Town Hall, 10 Maple Avenue, New City, NY 10956. Written comments on the Final EIS will be accepted until 14 days following the close of the Public Hearing. Copies of the FEIS are available for public review at the Town Hall or the Nanuet Public Library. The FEIS can be reviewed online at the applicant's consultant website, www.timmillerassociates.com or at the Town of Clarkstown web site, www.town.clarkstown.ny.us/html/planning.html.

The action involves a proposal by the Project Sponsor, Hyenga Lake Development LLC., to remove all existing structures on the project site, install the required infrastructure, and develop 107 units of affordable Senior Citizen housing in two, three story buildings in response to a continued demand for affordable Senior Housing in the Town of Clarkstown and Rockland County. This action is consistent with the existing MF-2 zoning, under a Special Use Permit. A newly constructed access to the site will be connected with Pipetown Hill Road. A secondary emergency access will be provided to NYS Route 59 via a driveway constructed over a deeded easement granted to the Hyenga Lake Development LLC by Wide World Realty, the adjacent property owner to the north. The project is located on Pipetown Road in the unincorporated area of the Town of Clarkstown, New York, approximately one-half mile south of Interchange 14 of the New York State Thruway.
