Project Description:

The applicant proposes to construct two new borrow areas located to the south of the existing Chaffee Landfill in the Town of Sardinia, Erie County. The proposed borrow areas, totaling about 29.4 acres, are for the excavation of clay in support of previously permitted landfill operations, primarily the construction and operation of the Western Landfill Expansion. Approximately 950,000 cubic yards of clay will be excavated above the water table. At least two feet of clay will be maintained/replaced above the underlying soil formation of coarse sand and gravel. The proposal also involves the installation of outlet structures from the two borrow areas to the regulated adjacent area of freshwater wetland SD-1. A total of about 1,830 square feet of the wetland adjacent area will be disturbed. Two permanent pools/wetland areas, totaling 49,800 square feet will be created. Plantings of floating stemmed and submerged aquatic vegetation are proposed for the permanent pools. The proposed borrow areas will be reclaimed to upland meadow (with plantings of clover, fescue and rye), open water and wetland. Plantings of trees are proposed for the southern boundary of each borrow area. Other operations under the existing Solid Waste Permit will not be changed.

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The Department has drafted a Part 373 Permit and made a tentative determination to renew the permit for CECOS International, Incorporated (CECOS) to continue existing monitoring and maintenance of closed hazardous waste units, and to continue final corrective action remedies which address site-wide soil and groundwater contamination at the CECOS facility. Commercial activities are no longer conducted at the facility. The renewal would continue the mechanism for perpetual post-closure care of closed hazardous waste units and corrective action systems. The majority of the CECOS facility is in the Town of Niagara with the remainder in the City of Niagara Falls.

The construction of an Americans with Disabilities Act approved fishing pier in the Niagara River located in Gratwick Riverside Park along River Road in the City of North Tonawanda. Approximately 565 cubic yards of concrete and stone fill will be placed on the existing river bed that will cover an area of 4,650 square feet to accommodate the construction of the fishing pier on a existing rock revetment.
