Project Description:

The applicant proposes to reopen the 63.1 acre Hilltop Sand & Gravel mine located approximately 1.4 miles west of CR 20 on property owned by Finger Lakes Equipment, LLC., in the Town of Portage. No significant changes are proposed to operational activities, reclamation plans, production volumes, or vehicle trips, etc. The mine operates as a traditional surface extraction of sand and gravel. Final reclamation will restore the site to agricultural use. The reviewed LOM area is 63.1 acres.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was performed.

SEQR Lead Agency: NYS Department of Environmental Conservation

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Sep 25, 2009.

Project Description:

The Department is prepared to issue a five year permit for the continuation of the annual opening and closure of the seasonal East Bay inlet channel to allow small recreational watercraft to access Lake Ontario from the bay. The 130 lineal foot long by 50 lineal foot wide channel is excavated to a maximum depth of 8 feet with approximately 400 to 600 cubic yards of material removed, stockpiled on the bar and then used to refill the channel. The channel can not be opened prior to May 15 and must be closed by October 15 of each year. The project is located on the East Bay Barrier Bar in the Town of Huron, adjacent to the inlet pier.

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.
