Project Description:

The project involves the maintenance dredging of approximately 600 cubic yards of rock and debris from the intake and tailrace areas to maintain hydraulic efficiency at the site. Dredging will occur during low flow conditions and silt curtain will be properly employed. Dredge spoils will be deposited at an approved on-site upland location and contained within a silt fence.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Project Description:

To obtain authorization under Section 404 of the Clean Water Act and to comply with standards set down in 33 Code of Federal Regulations (CFR) Part 332, Compensatory Mitigation for Losses of Aquatic Resources, EDGE has developed a wetland mitigation package to compensate for proposed impacts to waters of the United States at the Marcy NanoCenter site.

DEC's Oriskany Flats Wildlife Management Area (OFWMA) has been selected for the off-site component of the mitigation plan. OFWMA portion of the mitigation consists of 4 components: forested wetland creation, upland grassland management, marsh/wet meadow enhancement, and stream corridor enhancement. An 8.6 acre forested wetland will be created on DEC lands adjacent to the Barge Canal and just northwest of River Road. This wetland creation is to mitigate for the 4.53 acres of forested wetland to be impacted at the NanoCenter site.

Approximately 58 acres of existing wet meadow, comprised mostly of Reed Canary Grass, will be inundated by the creation of 2 low berms and installation of ditch plugs. This site is located at the northwestern end of OFWMA adjacent to the CSX railroad tracks.

The upland grassland management consists of hedgerow and woody vegetation removal that will result in 15 acres of contiguous grassland. Currently, open grasslands are being overgrown with trees, shrubs, and expanding hedgerows. The applicant has committed to removing the undesirable vegetation, seeding the area to cool and warm season grasses, and performing maintenance mowing for 3 years post initial establishment.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. The report of the survey is on file. No archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
