Project Description:
As part of the development of an apartment complex on a 17.4+/-acre site the project sponsor will install a 3 sided culvert on Shipbuilder Creek. The project itself will result in 0.08 acre of unavoidable impact to federal wetland. The project must comply with the Department's SPDES General Permit for Stormwater Discharge from Construction Activity, Permit No. GP-02-01. Issuance of the 401 Water Quality Certification will be dependent upon receipt of concurrence from the Town of Webster, the MS4 community, that project plans comply with this General Permit. The project is known as The Preserve at Woods Creek and is located 622-626 Ridge Rd. in the Town of Webster.

State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:

The Department has received an application from the Town of Palmyra for the installation of watermain in the Johnson Road Water Improvement Area on Johnson Road and South Townline Road in the Town of Palmyra. A portion of the watermain is proposed to be installed within the regulated 100 foot adjacent area of NYS Freshwater Wetland PA-35 in the right of way of Johnson Road. Proper sediment and erosion controls will be employed to maintain the water quality of the wetland resource.
The Department has made a tentative determination to approve this application. As a tentative determination, the Department is seeking public comment prior to making a final decision on permit issuance.
