Project Description:

The Department (DEC) has drafted a modified permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law and Title V of the Federal Clean Air Act Amendments, and made a tentative determination to approve this application for a permit modification proposed by the permittee. The modification involves adding a powdered activated carbon injection system and CONSOL's Low Temperature Mercury Capture Process on the exhaust ductwork of Boiler 12 at the Samuel A. Carlson Generating Station (Carlson Station) to reduce mercury emissions from that boiler. The permittee is pursuing this work to comply with the State mercury limit which becomes effective January 2010. Since the Title V Facility Permit was renewed in April 2007, the Oxides of Nitrogen and Sulfur Dioxide Trading Programs, Carbon Dioxide Budget Trading Program, and annual limits on Mercury emissions regulations have become effective and applicable to the permittee. Therefore, additional permit conditions have been included in the draft permit.

In accordance with 6 NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the US Environmental Protection Agency has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6 NYCRR Part 201.

Project Description:

The applicant has proposed a 100 foot vertical expansion of the Chautauqua County Landfill, which would cover approximately 33 acres over the existing landfill footprint. The proposed expansion will have a volume of approximately 2.269 million cubic yards. The proposal also includes construction of a new liner system over the top of the older phase I and III cells of the existing landfill. The proposal requires modification to the facility's Solid Waste Management Permit and Air Title V (ATV) Permit. The ATV Permit modification is described in a separate notice. The approved waste acceptance rate at the landfill is not proposed to be changed. Project Description:

The Department has prepared a draft permit and has made a tentative determination to approve this application for a major modification of the Air Title V Permit for the Chautauqua County Landfill facility. The draft permit includes a proposed 100 foot vertical expansion of the landfill and all existing equipment, operational measures and regulatory requirements. The expansion is proposed to cover approximately 33 acres over the existing landfill footprint. The proposed expansion will have a volume of approximately 2.269 million cubic yards. Gas generated by the existing landfill and the expansion area will be directed to the existing landfill gas fueled electricity generating facility and/or the open flare. Filtering, dewatering, and compressing the gas prior to combustion in the internal combustion reciprocating engines will treat the landfill gas as provided in 40 CFR 60.752(b)(2)(iii)(C).

The uncontrolled non-methane organic compounds emission rate from the existing landfill is estimated to be greater than 50 megagrams per year. Therefore, this permit action includes collection and control requirements for the landfill gas as specified in 40 CFR 60 Subpart WWW. The facility wide potential emissions of Nitrogen Oxides and Volatile Organic Compounds are less than the major source threshold of 100 tons per year (tpy) and 50 tpy, respectively. As such, the facility is not subject to the 6NYCRR Part 231-2 New Source Review requirements or the NOx Reasonably Available Control Technology limits. As per 40CFR52.21 - Prevention of Significant Deterioration (PSD), the existing landfill is a major source of carbon monoxide emissions. The proposed vertical expansion projected emissions of the attainment area pollutants were compared against the PSD significant emission rates. The proposed vertical expansion will not cause an emissions increase above the significance thresholds and, therefore, is not subject to PSD review.
