Project Description:

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 002 4422), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS).

As a result of comments received from the permittee, this is a re-notice of the Notice of Intent to Modify published in the ENB on 2/25/09. The Town of Wallkill Sewage Treatment Plant has a maximum design flow of 4.0 mgd. The facility has a treated surface discharge into the Wallkill River, a class B water. The following changes to the permit are proposed: The draft permit included an Inflow and Infiltration Management Program section which has been replaced by a compliance schedule action item requiring a Collection System Monitoring and Maintenance program. Under this program the permittee will be required to prepare a plan and schedule for continuous, ongoing sewer system assessment, flow monitoring, correction and maintenance to control infiltration and inflow to the collection system. A 3 year, 3.5 lbs/day interim limit for copper has been added to the permit to allow flow reduction efforts to begin before the 2.0 lbs/day water quality based limit goes into effect. The whole effluent toxicity (WET) testing description has been modified to allow the testing for year 2010 to be made up of 4 quarterly samples collected during the last 2 quarters of 2010 and the first 2 quarters of 2011. The permit limit, monitoring and quantification and removal study for benzidine has been removed. All sampling data for benzidine since February 2005 have been reported as not detected and the inclusion of benzidine is not warranted. Significant Industrial Users in the Pretreatment Program Section has been updated.

Project Description:

The Department has prepared a draft State Pollutant Discharge Elimination System (SPDES), permit (NY-0271284) and has made a tentative determination to approve an application by the City of Middletown to construct a new 5 million gallon per day (MGD) Water Treatment Plant (WTP). This plant will replace the existing Monhagen Water Treatment Plant. This proposed surface water WTP will utilize a Dissolved Air Floatation (DAF) process. The DAF process includes a filtration component which will require periodic backwashing to be discharged to Monhagen Brook (Water Index #: H-139-13-52 , Class C) The Applicant is applying for a SPDES permit to discharge up to 250,000 gallons per day of backwash wastewater from the wastewater holding tank. The outfall is located approximately 19 feet northwest of Monhagen Brook and will require a short overland flow before discharging to the stream.

Project Description:

The Department has made a tentative determination to approve this application for modification to an existing SPDES permit # NY- 0101109 for Crescent Lake Estates, located at 924 Old Liberty Road, Monticello, to increase the discharge from 5,500 gallons to up to 11,500 gallons of treated wastewater per day to an unnamed tributary to East Branch of Mongaup (Water Index # D-10-28; Class B(t)) as part of the facility expansion. Five new duplex homes are proposed to be added to the summer colony.

The applicant proposes to replace the current sand filter treatment system with a new expanded system to allow the proposed increase in discharge. The existing discharge pipe will be used, so no new physical disturbance to the bed or banks of D-10-28 is proposed. The effluent will undergo chlorine disinfection prior to entering the stream. The permittee will be required to maintain records and report data to verify compliance with the SPDES permit conditions and discharge limits.

A draft SPDES permit with DEC proposed effluent limits and monitoring requirements is available for review at the DEC Region 3 headquarters in New Paltz.
