Project Description:
The Department has made a tentative determination to issue a permit for the Town of Portland Highway Garage. The permit (NY-0275441) would authorize the discharge of up to 100 gallons per day of vehicle washwater after treatment by an oil-water separator. The discharge is to Corell Creek (Class and Standard of C) tributary of Lake Erie. The permit also lists a discharge of up to 125 gallons per day to groundwater from a sanitary wastewater system. The Department is seeking comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought. When commenting, please refer to this application by both the application number and the SPDES number listed in this notice. The Draft Permit, with conditions, application, relevant supporting materials and regulations are available during normal business hours at the DEC office provided in this notice. Comments of support or objection may be made by filing a written statement by the deadline date indicated.

State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.
SEQR Lead Agency: None Designated
State Historic Preservation Act (SHPA) Determination:
Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:
The department intends to issue a permit to mine sand and gravel on 26 acres of land out of 127.2 acres owned at the site, as previously permitted. There will be no changes to the previous mining plan, which includes a wash plant processing system with no off-site discharge of wash water. The reclamation plan is for a 1.5 acre pond and the remainder for agricultural purposes. The estimated life of the mine is 10 years. The mine site is located north of NYS Route 78 (Strykersville Road) and west of Schang Road.
