Project is Located:
The department has reviewed and determined that a Draft Environmental Impact Statement and Mined Land Use Plan prepared by the applicant for a 78 acre commercial limestone mine near the Village of Port Leyden is complete for the purpose of public review and comment. The mine site is located on a 112.62 acre parcel owned in-part by the applicant, Andrew and Catherine Millick, 3141 East Road, Boonville, N.Y. 13309, and S.S.S.R. Associates, 6759 Hells Kitchen Road, Port Leyden, N.Y. 13433, and located approximately 2,000 feet north of the Village of Port Leyden. It is further located west of New York State Route 12, between the Hells Kitchen and Rugg Roads. On-site processing would take place, including: blasting, excavating, crushing, screening, sorting, and stockpiling of material. Approximately 300,000 tons of material would be mined annually, with fluctuations based on market demand. The life of mine is anticipated at approximately 50 years with terrestrial based reclamation upon completion of mining.

State Environmental Quality Review (SEQR) Determination:
A draft environmental impact statement has been prepared on this project and is on file.
SEQR Lead Agency: NYS Department of Environmental Conservation
State Historic Preservation Act (SHPA) Determination:
A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
