The applicant proposes expansion to the north, by 10.5 acres, of an existing, permitted, 29.5 acre mine. The proposed 10.5 acre parcel, located approximately 0.35 miles southwest of Fuller Road/Sullivan Road intersection, is part of 65 acre parcel owned by Jeremy Deyo. Mining in the new area will proceed as material in the existing mine is exhausted, and will be for the purpose of supplying sand to local dairy farmers. Fourteen acres of the existing mine are reclaimed, and ten acres are to be reclaimed during the coming permit term. Reclamation will occur in the new area as mining progresses, with final relcamation consisting of graded side slopes, grass plantings, and eventual natural reforestation.

Project Description:

The applicant proposes to modify an existing discharge of up to 60,000 gpd of treated sanitary wastewater to Lake Champlain, a Class B waterbody, from a secondary treatment plant at the applicant's facility located at 17 Monitor Bay Park in Crown Point. The required Total Phosphorus (TP) limit has been added to their SPDES permit to comply with the Lake Champlain Total Maximum Daily Limit (TMDL) in accordance with Section 303(d) of the Federal Clean Water Act. This limit represents the TP TMDL point source allocation of 0.53 lbs/day contained in the Lake Champlain Management Plan plus 0.50 lb/day TP trade agreement with International Paper Company's Ticonderoga Mill (SPDES No. NY0004413).

The Department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify Department approval for or endorsement of the activity for which a permit is sought or for the overall proposed project.

The applicant proposes a modification of an existing discharge of up to 17 mgd of treated process wastewater to Lake Champlain, a Class B waterbody, from a tertiary treatment plant at the applicant's facility located at 568 Shore Airport Rd. in Ticonderoga. The applicant proposes a 0.50 lbs/day reduction to the Total Phosphorus (TP) limit under a same-point source trade agreement with the Town of Crown Point SD #1 WWTF (SPDES No. NY0239844). The TP for Outfall 001 will be reduced from 38.3 lbs/day to 37.8 lbs/day. In addition, the monitoring frequencies of various parameters of Outfall 001 and Outfall 01A will be reduced.
