Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a Title V Renewal with modifications to include a Clean Air Interstate Rule modification and CO2 Budget Trading Program and Greenhouse Gas Initiative Requirements.

The facility consists of one GE 7FA combustion turbine, one heat recovery steam generator (HRSG) equipped with a duct burner for supplemental firing and one steam turbine. The plant will have a nominal generating capacity of approximately 250 megawatts.

This modification includes conditions recently promulgated under regulation 6 NYCRR Parts 243, 244 and 245 that require facilities to obtain/possess at least as many allocations of sulfur dioxide (SO2) and oxides of nitrogen (NOx) as they emit into the atmosphere during a specified period of time. An allocation is a unit of pollution which is limited by a budget established by the regulations. The Department developed these regulations in response to the United States Environmental Protection Agency Clean Air Interstate Rule (CAIR). The regulations are included in New York's State Implementation Plan (SIP) which has been approved by EPA as required by the Clean Air Act of 1990. In addition, 6 NYCRR Part 242 has been added under CO2 Budget Trading Program and Greenhouse Gas Initiative Requirements.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

Operation of a temporary dewatering system to facilitate the construction the Phase II Upgrade at the Jamaica WPCP, with a maximum withdrawal and discharge of up to 2,592,000 gallons per day. Dewatering discharge is to be directed to a settling tanks and then to an existing onsite storm sewer from the Secondary Screening Building and the Main Boiler Addition work areas which discharge to Bergen Basin via NYCDEP Outfall JAM-006 and to the chlorine contact tank effluent outfall (at a location beyond any WPCP sampling station) for the Effluent Pump Station work area, which discharges to Bergen Basin via NYCDEP Outfall JAM-001.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

The Department has made a tentative determination to approve this application for a new permit for a proposed withdrawal and discharge of up to 1.2 million gallons per day of treated groundwater into the Kill Van Kull (Class SD) via NYCDEP Outfall PR-029 from a treatment system consisting of a settling tank at the applicant's project site located on Richmond Terrace between Nicholas Avenue and John Street in Richmond County where the applicant will reconstruct sanitary and storm sewers.
