Brownfield Cleanup Program

The New York State Department of Environmental Conservation (NYS DEC) administers the Brownfield Cleanup Program (BCP) pursuant to State Environmental Conservation Law (ECL) §27-1400 et seq. The BCP was created to encourage the remediation and redevelopment of contaminated properties known as brownfields. The requestor (named above) has submitted a BCP application asking that this site be admitted into the BCP.

NYS DEC will accept public comments concerning the application. A copy of the application and other appropriate documents (application package) is available in the site document repository location at the address indicated below.

NYS DEC will review the application package and public comments received and then make a determination on the eligibility of the application.

Negative Declaration

Monroe County - The Town Board of the Town of Ogden, as lead agency, has determined that the proposed Forest Creek Equity Corporation Rezone will not have a significant adverse environmental impact. The action involves the rezoning of 26.79 from R-1 Single-Family Residential District to RB Restricted Business District. The project is located at Brockport-Spencerport Road and Washington Street in the Town of Ogden, New York.

Monroe County - The Penfield Planning Board, as lead agency, has determined that the proposed LaSalle Landing may have a significant adverse impact on the environment and a Draft Environmental Impact Statement must be prepared. The action involves the proposal for Preliminary and Final Subdivision and Site Plan approval, Special Permit, and Environmental Protection Overlay District Permit to allow the construction of three condominium buildings with eighty-seven residential units with garages and parking areas on 35.18 ± acres utilizing Town Law §278 with remaining lands proposed to be open space. The property is now or was formerly owned by Ric-Bay Incorporated and is zoned LLD and R-1-20. The project is located at 1185 Empire Boulevard and 41 Wilbur Tract Raod in the Town of Penfield, New York.
