Project Description:

This Notice is for renewal of an existing State Pollutant Discharge Elimination System (SPDES) permit for an existing discharge of 120,000 gallons per day of treated institutional wastewater to Witherspoon Brook Tributary, a Class D waterbody, from a tertiary treatment plant at the Altona Correctional Facility located at 555 Devil's Den Road in the Town of Altona, Clinton County. The applicant plans to continue to operate the facility. In addition, the Department has made a tentative determination to modify the permit by 1) decreasing the effluent limit for total phosphorus from 1.75 pounds per day 30 day arithmetic mean to 0.54 pounds per day 12 month rolling average to comply with Section 303(d) of the Federal Clean Water Act and the Lake Champlain Total Maximum Daily Load limit., and 2) reducing the sampling frequency for Biochemical Oxygen Demand (BOD), 5 day; Total Suspended Solids (TSS); and Total Phosphorus from twice per month to once per month. As a tentative determination, the Department seeks comments prior to making a final decision on permit renewal. State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jul 03, 2009.
