Project Description:

The Department has received a Mined Land Reclamation application from The Town of Avoca for a new 5.5 acre sand and gravel mine on a 28.19 acre parcel in the Town of Avoca. The mine site is located on Town of Avoca property on the southeast side of Reservoir Road approximately 2000 feet southwest of the intersection of Jacobs Ladder Road.
Excavation by bulldozer and front end loader is proposed to remove 190,000 cubic yards of sand and gravel from the life of mine area over an approximately 5 year operational life. Topsoil and overburden will be stockpiled and seeded for later use in site reclamation. Excavated material will be processed on site by dry crushing and screening. Crushing and screening will occur once a year and will be limited to a two week period, and be done by a contractor hired by the Town. Processed material will be stockpiled for loading onto trucks. The Town has estimated maximum traffic from mining operations to be 10 trucks trips per hour.
Mining is not proposed below the local water table. Reclamation will occur when mining operations at the site are completed, and will include replacement of stockpiled topsoil and seeding to re-vegetate the site. Control of storm water on the site will involve sloping the mine floor into the face of the excavation to allow storm water infiltration, sufficient to prevent storm runoff from leaving the mine area. The mine floor will be below the elevation of Reservoir Road. No off site discharge of storm water runoff from the mined area will be permitted.
Hours of operation proposed are 6 AM until 4:30 PM on weekdays only, with no operations on weekends or holidays. Final reclamation to open land is proposed, and will include the replacement of stockpiled topsoil and seeding with a seed mixture suitable to establish vegetative cover, with the reclaimed mine floor sloped away from Reservoir Road to prevent runoff from the site after reclamation.

Availability of Application Documents:

Filed application documents, and Department draft permits where applicable, are available for inspection during normal business hours at the address of the contact person. To ensure timely service at the time of inspection, it is recommended that an appointment be made with the contact person.

State Environmental Quality Review (SEQR) Determination:

Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

SEQR Lead Agency: None Designated

State Historic Preservation Act (SHPA) Determination:

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:

Comments on this project must be submitted in writing to the Contact Person no later than Jun 29, 2009.
