The Department has made a tentative decision to approve an application to surrender the permit and to approve Volatile Organic Compound (VOC) Emission Reduction Credits (ERCs) for the past emission reductions resulting from the permanent shutdown of the Mobile Oil Corporation - Syracuse Terminal operation. With this shutdown, the applicant will be establishing 48.195 tons per year of VOC ERC's in accordance with 6 NYCRR Part 231 "New Source Review In Nonattainment Areas And Ozone Transport Regions". The application and supporting documentation are available for review at the NYSDEC Region 7, 615 Erie Boulevard West, Syracuse, NY 13204-2400. Comments will be received for a period of 30 days from the date of this notice.

Project Description:

The Department has prepared a draft permit and has made a tentative determination to issue a renewal Air Title V Facility Permit for the operation of a 990 ton per day nominally sized waste-to-energy facility. The OCRRF consists of three independent mass burn combustors with waterwall boilers, each with a design capacity of 330 tons per day (reference waste of 6000 btu/lb). Refuse is delivered to the OCRRF in standard packer trucks and transfer vehicles for combustion. Refuse is reduced approximately 90% by volume in the combustion process. Heat energy generated in the combustion process is utilized to produce electricity in a 39.5 megawatt turbine generator. This electricity provides power to the OCRRF and the excess is sold to a power reseller or broker. Auxiliary burners firing natural gas are used during periods of startup, shutdown and at other times when the minimum combustion zone temperatures would not otherwise be met. Air pollution control includes dry scrubbers for acid gas control, fabric filters for particulate removal, a selective non-catalytic reduction (sncr) system for NOx control and a carbon injection system for mercury control.
The draft Title V Facility Permit incorporates revisions to emission limits, operating practices and performance testing and monitoring requirements associated with changes made to 40 CFR Part 60 Subpart Cb on May 10, 2006. However, the current permit limits for cadmium, lead, mercury, and particulate matter are more stringent than those contained in the Federal rule and remain in effect. Other major revisions of the Federal rule including changes to operator stand-in provisions and continuous emissions monitoring data availability have been incorporated into the permit. The Federal emission limits were revised based on year 2000 to 2005 test data from more than a dozen municipal waste combustor units.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

Persons wishing to inspect the subject Title V files, including the application with all relevant supporting materials, the draft permit, and all other materials available to the DEC (the "permitting authority") that are relevant to this permitting decision should contact the DEC representative listed below. DEC will evaluate the application and the comments received on it to determine whether to hold a public hearing. Comments and requests for a public hearing should be in writing and addressed to the Department representative listed below. Project Description:

The applicant proposes to construct 200 feet of new rock revetment approx. 8 feet high along the toe of the sand dune on Lake Ontario for erosion protection. The site has been eroded severely leaving a slope too steep for vegetation to provide the erosion protection. The application and project plans are available for review in the Syracuse Office.

Cultural resource lists and map have been checked. No registered, eligible or inventoried archaeological sites or historic structures were identified at the project location. No further review in accordance with SHPA is required.

Coastal Management:

This project is located in a Coastal Management area and is subject to the Waterfront Revitalization and Coastal Resources Act.

Opportunity for Public Comment:
