Project Description:

The Dutchess County Water & Wastewater Authority (DCWWA) has applied for a Water Supply permit (WSA# 11,224) to construct a 7,000-foot long pipeline to connect two of the Water Authority's existing water service areas and to serve approximately 62,000 gallons per day to properties along the pipeline in a new service area know as Zone of Assessment "L". Water would be supplied by the Water Authority's Hyde Park Water Treatment Plant. The pipeline would be constructed along NYS Route 9G, from a point apprximately 500 north of Haviland Road to White Oak Road, would continue on to Brower Boulevard, and would also extend along White Oaks Road to Coleman Road.

Construction would involve installing the water line under the Maritje Kill (Class B) and disturbing a portion of Freshwater Wetland #HP-23 (Class 2) and its 100-foot wide adjacent area, which abuts this section of Route 9G, in the Town of Hyde Park, Dutchess County, NY.

The New York State Department of Environmental Conservation (DEC) is pursuing a Department Initiated Modification (DIM) to the State Pollutant Discharge Elimination System (SPDES) Permit (NY 006 2251), pursuant to 6 NYCRR Part 750-1.18, New York State's Environmental Benefit Permit Strategy (EBPS). A monitoring program to include interim technology based limit and a schedule to meet the new ammonia limits has been added. To gather information, a monitoring program to sample the receiving water upstream and downstream from the discharge as well as the effluent has been added. An interim technology based limit for total residual chlorine will be in effect until upgrades are completed. The sampling of fecal coliform has been changed from daily to monthly.

Project Description:

The Department has prepared a Draft Permit pursuant to Article 19 (Air Pollution Control) of the NYS Environmental Conservation Law (ECL) and Title V of the Federal Clean Air Act Amendments and made a tentative determination to issue a Title V Air Permit renewal for the operation of the Warex Cargo facility.

The Warex Cargo facility, located within the Town of New Windsor, is a gasoline and distillate oil storage and distribution terminal. The facility operates a loading rack used to fill cargo trucks with gasoline and distillate fuel. Vapors are recovered from the gasoline loading operation and controlled by the operation of two open flares.

Distillate oil and gasoline throughputs are limited by Federally Enforceable conditions established as part of initial permitting. The throughput limits support Hazardous Air Pollutant emissions are below major stationary source thresholds. The facility is subject to Title V permitting for potential emissions of volatile organic compounds above major stationary source thresholds. The Warex Cargo facility is subject to numerous monitoring, recordkeeping and reporting requirements outlined by permit conditions under federal and state regulation including but not limited to 6NYCRR 201, 6NYCRR 225, 6NYCRR 229, and 40CFR Part 63-BBBBBB.

The Standard industrial Classification representative of this facility is 5171 - Petroleum Bulk Stations and Terminals.

By acceptance of this permit, the permittee agrees that the permit is contingent upon strict compliance with the ECL, all applicable regulations, the General Conditions specified and any Special Conditions included as part of this permit.

In accordance with 6NYCRR Parts 621.7(b)(9) and 201-6.4(c), the Administrator of the United States Environmental Protection Agency (USEPA) has the authority to bar issuance of any Title V Facility Permit if it is determined not to be in compliance with applicable requirements of the Clean Air Act or 6NYCRR Part 201.

The applicant proposes to dredge 22,227 cubic yards of material from an in-stream pond within a tributary to Pascack Brook (Class B), regrade the pond, and construct various drainage improvements including a new stormwater detention basin in conjunction with the construction of a 160-unit apartment complex, Blueberry Commons, on a 16.8-acre parcel. Dredge spoils will be disposed of within the site and used to regrade the pond. The project will fill approximately 0.26 acres of federally regulated wetland; approximately 0.43 acres of new wetland will be constructed and planted at the project site as mitigation. The project is located on the east side of Monsey Ladentown Road and north of Ralph Boulevard in the Town of Ramapo, Rockland County.
