Project Description:
The applicant proposes to add 3.6 acres of land to the Canada Hill sand and gravel mine, currently permitted for 3.5 acres. Material processing will include use of a portable screen with a maximum capacity rate of 300 tons per hour. There will be no excavation into the water table, and no water supply wells, wash ponds or wet processing proposed. The site will be reclaimed to its present use of pastureland. The mine site is the former Holmes and Murphy Canada Hill Gravel Pit, located on the north side of Canada Hill Road, with the haul road/entrance road approximately 1500 feet east of the intersection with NYS Route 240.

State Environmental Quality Review (SEQR) Determination:
Project is an Unlisted Action and will not have a significant impact on the environment. A Negative Declaration is on file. A coordinated review was not performed.

State Historic Preservation Act (SHPA) Determination:
The proposed activity is not subject to review in accordance with SHPA. The permit type is exempt or the activity is being reviewed in accordance with federal historic preservation regulations.
Coastal Management:
This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
Opportunity for Public Comment:
Comments on this project must be submitted in writing to the Contact Person no later than Jun 19, 2009.

The Department has made a tentative determination to renew State Pollutant Discharge Elimination System Permit (SPDES #NY 0127914) for Vito's Property Management (previously known as Stevens Motel). The permit will authorize the discharge from two septic tank/sand filter systems to an existing storm drainage ditch which is tributary to Eighteenmile Creek. The draft permit is on file at the Region 9, Buffalo office.
