Project Description:

The applicant proposes to develop and operate a new 29.5 acre sand and gravel mine on State Route 13 approximately one mile north of the intersection of SR 13 and East Franklin Street in the Town of Horseheads. The mine will operate as a traditional surface excavation of sand and gravel using mechanical equipment standard for this type of mining operation. Mining will occur in three phases from south to north on the site and will include mining below the water table. A loader, truck and portable screening plant (on occasion, a crusher may also be used) will remove sand and gravel until the water table is reached and then mining will continue utilizing a dragline. Reclamation will be concurrent with mining and will result in an addition of approximately 22 acres of water surface to the existing Hanson Aggregates, Inc. pond system adjacent to this site. The reviewed Life-of-Mine area is 29.5 acres.

State Historic Preservation Act (SHPA) Determination:

A cultural resources survey has been completed. Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have no impact on registered or eligible archaeological sites or historic structures. No further review in accordance with SHPA is required.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.

Project Description:

The proposed Ecogen Wind LLC Prattsburgh/Italy Wind Farm Project (Project) involves construction of 34 industrial wind turbine generators across 287.1 acres in the Towns of Prattsburgh and Italy. Each 305 ft turbine (including tip of rotor) would have a nameplate capacity of 2.3 megawatt (MW) for a total Project capacity of 78.2 MW. The Project also involves construction of 9.8 miles of access roads (4.6 miles of access roads in the Town of Italy and 5.2 mile of access roads in the Town of Prattsburgh) and 23.2 miles of electrical collection line (7.0 miles in the Town of Italy and 16.2 mile in the Town of Prattsburgh). Moreover, a substation and an operations and maintenance building will be built. Two temporary 11-acre staging areas and one temporary concrete batch plant would be required during the construction phase.

There are no permanent impacts to wetlands, or their 100 foot adjacent areas, from construction of the wind farm. However, there are a total of 1.66 acres of temporary impacts to the 100 foot adjacent area of NYS DEC regulated wetland PB-1. These impacts, which require a DEC Permit, are due to electrical collection system installation and involve the clearing of 0.51 acres of upland forest. To compensate for this impact, as well as more extensive impacts to federally regulated wetlands, Ecogen LLC is proposing wetlands mitigation involving 5 possible sites and the proposed creation of over 1 acre of wetland.

There are also no permanent impacts to DEC protected streams. However, there is 0.0446 acre and 153.9 linear feet of temporary impact to the stream flowing through Segar Gully. This is a perennial stream classified as C(ts) - a stream in which trout spawn. The impact is due to an open trench as part of an underground electrical collection system installation and this activity thus requires an Article 15 Permit. Moreover, a separate written Water Quality Certification (WQC) will be required for the project under Section 401 due to potential discharges into a state water body from activities regulated under a federal wetland disturbance permit.

Based on information provided in the survey report, the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) has determined that the proposed activity will have an impact on registered or eligible archaeological sites or historic structures. The department must consult further with OPRHP before making a final decision regarding the issuance of the permit.

Coastal Management:

This project is not located in a Coastal Management area and is not subject to the Waterfront Revitalization and Coastal Resources Act.
