The department has made a tentative determination to issue a permit for a State Pollutant Discharge Elimination Sytem (SPDES) permit under Article 17 of the Environmental Conservation Law. This tentative determination indicates that the discharge regulated under this statute is considered to satisfy regulatory standards for permit issuance, based on information available to the Department at this time. As a tentative determination, the Department seeks comments on the proposed regulated activity prior to making a final decision on permit issuance. As such, this tentative determination does not signify approval for or endorsement of the activity for which a permit is sought, or for the overall proposed project. The applicant proposes to renew and modify an existing SPDES permit for a wastewater treatment plant which currently discharges 600,000 gallons per day (gpd) of treated sanitary wastewater to the Hudson River, a Class A waterbody, from a primary treatment plant at the applicant's facility located at 194 North Washington Avenue, Town of Athens, Greene County. In addition, several upgrades are proposed: addition of a second outfall to discharge 30,000 gpd of potable water plant filter backwash; installation of chlorine injection pump to reduce odors, surge tank flow controls, process tank conversions and sludge bed rehabilitation. The Department has made a tentative determination to renew and modify a permit for a State Pollutant Discharge Elimination System permit under Article 17 of the Environmental Conservation Law.
