The New York State Department of Environmental Conservation (Department or NYS DEC) has prepared the Program Policy: Solid Waste Management Facility Permitting Policy
This Program Policy clarifies the Department's requirements, procedures, and responsibilities with regard to solid waste management facility permitting for new facility construction, existing facility expansion, and acceptance rate increases. The policy seeks to maximize the Department's use of the permitting process to facilitate comprehensive solid waste management planning and ensure best practices in solid waste management facility operations. It aims to increase materials recovery, reduce the environmental impact of waste management, reduce greenhouse gas generation, extend the useful life of the State's landfill capacity resources, and minimize landfill encroachment on the State's natural resources.
The Department has classified this action under the State Environmental Quality Review Act (ECL Article 8; Part 617 of Title 6 of the Official Compilation of Codes Rules and Regulations of the State of New York) as an Unlisted action. The Department is the only involved agency.

This Program Policy will be effective 30 days from the date of publication of this notice.
